He said it depends on how much the other guy wants to fight it out and that it may be a long drawn out expensive process

I don't think the common man knows the answer. You need to get an attorney and hire him or her if you want to pursue it. I'm sure it will cost you and the property is probably worth less than the value of the receipts.

the family may not be able to get any sort of money for the shop expansion, but if the deceased purchased all the tools, then they would belong to his family unless there was an agreement in place that all the tools could stay with the other day (which you didn't say there was)
