They've started to overturn some in the Netherlands. People are just now starting to realize that all of the studies that these bans were based on were false. It is also starting to be realized who is behind a lot of these bans and that is starting to shed new light on things.

Things add up. Look at all the huge companies that moved out after years of mounting regulations.
9 million people visit New Orleans every year. If you take nationwide averages, 20% of those visitors are smokers. SOOOO that leaves you with potentially 1.8 million people that could get fined or get turned off to the city by this ban.
Will this ban attract new visitors? As a non smoker, smoking has never deterred me from visiting the city but I would have second thoughts if I was to be fined.

what does this have to do with anything?
we're talking political philosophy/theory here. the states, sadly, have this sort of regulatory authority. it's not a legal issue

you're being obtuse. it has no bearing on this discussion. the legal authority is settled.
a long time ago courts ruled that they didn't respect property rights and they have not yet overturned these laws
this is about legal-political theory

people are joyous and happy to use government to get their way and engage in crony capitalism...as long as it is something that they believe in. many of these people are avoiding that issue and are trying to spin this as a "health issue" to avoid admitting they're being selfish (and almost assuredly hypocrites).
