Also, I didn't see evidence of cooperative learning groups, GLE's on the board, or bell work being completed.

I teach some less than stellar kids, but I couldn't imagine that happening in class...not for taking a phone.

Cell phones were not widely used when I was in high school. But if I was reading a book instead of paying attention, that book would have been taken by the teacher until after class. I don't see how a phone is any different. The kids are there to learn.
