That doesn't appear that way to me. It was way less serious than I expected from the OP. I can understand why the guy may have been scared, and it certainly *may* rise to the standard, but...

What more has to happen before you think he has a right to defend himself?

You have a right to defend yourself, its whether you can reasonably use lethal force that can result in death or great bodily harm in that instance.

In Wisconsin under the law that I am looking at...it seems very borderline at best.

I could see this one going either way. Its nowhere near as clear as you all want it to be.

You didn’t see yellow shorts guy trying to shove his head under the water? I’m not a doctor, but most people can’t breathe under water.

The worst people you can put together as a group are teenagers especially in an environment that lacks proper adult supervision. I don't care what color they are, what social class they come from. You can take relatively decent kids (teenagers) and if you put them with a group of friends in the wrong environment they are going to be idiots.

frick em. If they want to play around with a grown man then anything that comes their way they deserve. I feel bad for the family and the guy who has to live with that for the rest of his life, but frick those idiots.

Nope. I have watched it 3 times and I don't see it. He pushes him, then pushes him again which is when he got stabbed.

Look these kids are punks and I'm perfectly fine with this dude getting nothing. frick those punks.

However, from the video and what I am seeing on WI law... its way more borderline.

I’ve watched 5 days of the trial and have seen every single state witness change their story. Some of them multiple times.

The guy had been under water once.

You didn’t see yellow shorts guy pushing down on his back and neck while he was prone on the river bed?

He doesn't have to be in his dwelling or in his car. He can still defend himself in Wisconsin. He's got to prove he reasonable feared death or great bodily harm though

It looks like he easily could have walked away, there wasn't like 5 guys just all pummeling him on the ground.

Erm, I’m pretty sure one guy pushing you into the water while another punches you in the face is plenty reason to fight for your life bro.

I agree he had a few opportunities to de-escalate (and clearly so did that merry band of idiots), but eating knuckle sandwiches with your head half-submerged isn’t one of them.

he easily could have walked away. instead he pulled a knife.

is wisconsin a stand your ground state?

Wisconsin does not have a stand your ground law. Stand your ground laws in other states generally allow for a person to claim self-defense without first needing to retreat when outside their home or business. Wisconsin also does not have an affirmative duty to retreat.

Problem probably deescalates without incident had there been less alcohol consumed.

Just an observation.

Anyone from the Midwest that makes fun of the “rednecks” in the south need to keep quiet.

There are some straight up white trash mofos along Wisconsin/Minnesota border.

Seems as that speaks for itself. He doesn’t get attacked then nobody gets cut.
He was not the aggressor. FAFO

Situation went from 20 to 100 when the white trash brothers, their women, and dad got involved.

State of Wisconsin brings charges that they have to prove.

Defendant brings up an affirmative defense that he has to prove.

Does it have to be? I’m not a lawyer so maybe you’re right, but there’s a solid-non-zero chance that he hits his head on some rocks or goes to sleep after getting punched and drowns. The force that was being used against him could have been lethal and at that point was unprovoked.

IDK man, sad situation all around. I don’t think any verdict would surprise me.
