quote:

According to arrest documents, the trouble began when a man ordered a $6 draft beer at the Beerfest International Brewhouse, a bar at 410 Bourbon St. As the beer was being poured, a friend of the customer told him he had just purchased a beer outside for only $3. The customer asked the bartender whether she would match that price. When she refused, the customer decided to walk away without touching or consuming the beverage.

quote:

a bouncer employed by Beerfest grabbed his arm and attempted to drag him back inside. When the man managed to free himself from the bouncer's grasp, he was "tackled against the wall and punched several times in the face by both Clarence Lacombe and his accomplice,"

quote:

During the altercation, a third friend of the men attempted to intervene and "defuse the situation," the report said. According to the document, the bouncer punched him in the face so hard the man's jaw was shattered and he immediately sought hospital treatment.

quote:

The detective's warrant affidavit said the original customer "sustained two cracked teeth which required dental procedures," and that the third member of his group "received injuries to his jaw which required surgical procedures." The detective also wrote that a responding NOPD officer's body-worn camera recorded "Lacombe's accomplice" admitting to striking the original customer as he tried to leave Beerfest.

In the bouncer's defense...he did get the $6 for the beer.

Where does the law stand on this?

Mostly on the legality of walking away.

I would think if you don't accept the beer, you don't have to pay. It's the bartender's fault for not getting the money up front.

I used to bounce in my early college days, walking away will usually get you banned for a night, nothing else.

Also, what I wouldn't have given for an overzealous bouncer to throw a punch at me in late college...

Nothing like delivering a good open hand hit to someone's jaw

It's all good when the bouncers are tossing drunks around but then you will get a meathead who thinks his SECURITY t-shirt gives him the right to legally attack anyone he wants. I remember LSU football players working the bars in Tigerland and just brutalizing drunks at the drop of a hat. They really need some Patrick Swayze rules about being nice. It was all good until he started punching people.

Naw, just give him his 6 bucks back and punch the douche that told him about the 3 buck beer again. Call it an indoor commerce rule.

No. I meant I'd...oh, never mind. I'm punch drunk.

Happy Independence Day, fella. Hope you and yours are all well.

oops, on topic. Yeah, that was all as senseless as most of my posts.

The person who really fricked up is the bouncer. For a paltry $6, where another customer most certainly would've come up right behind that customer and purchased said beer, the bouncer just cost his employer (or their insurance) some big bucks when he sues the frick out of him. And deservedly so.

Could be a simple kidnapping charge in this also;
