Is this insurance fraud?

I got rear-ended in my car a couple months back. It was not bad at all, but there are some paint scratches and a small dent that is barely noticeable.

The lady who hit me has accepted all liability and her insurance agent said they'd pay for all damages once I got an estimate. (I googled her BTW and her family is LOADED. A lesser man would've definitely gotten a "neck injury" )

That being said, what if I get an estimate and then pocket the check the insurance company gives me and don't fix my car? You can't see any damage unless you're looking for it and I really want a new leather recliner for this upcoming football season.


So two questions:

Is that fraud or is that my money that I can spend how I please?

And how much will I get for repainted a bumper and minor dent repair on a brand new, 2016 vehicle?

they don't give a shite what you do with the money. but rest assured you won't be able to go back and double dip.

fraud would be if you took a hammer to the bumper after the fact.

If it's financed the insurance company may include the lien holder on the check. Lien holder will want the vehicle fixed,

The rich lady hit me while I was stopped at a red light and scratched my brand new car up (before it's first oil change mind you).

I'm sure her insurance company will survive

No, that's not fraud. However, I don't think the insurance companies work that way any more.

No idea, but the real money they owe you is in the diminished value of your 2016 vehicle. You now must list the vehicle as being involved in an accident when you go to trade in or resell it.

Go to the nicest body shop around to get the estimate and then do the work at a cheaper place and pocket the difference.

No. Think of it as being paid upfront for the money that you won't be able to get when trying to sell your car with a dent in it.

Cat, take pictures of before and after.

More than likely they are going to cut the body shop the check and not you if the damages exceed a $1000. IF you owe anything on your car the lien holder will be on the check as well. They do this to protect the lien holder for the very reason you are proposing.
