If an HOA doesn't enforce a lot of rules and regulations, but still collect HOA dues

Would you pay them?

I'm talking about things like letting people park in the street overnight 365 nights a year, parking in yards, allowing broken down vehicles to stay in yards, allowing people to add narrow strips of concrete just wide enough for their tires, allowing fallen fences to stay down, overgrown yards, not maintaining outside appearances of homes, mailboxes leaning and in some cases completely fallen...

and worst of all IMO, allowing more than the approved percentage of homes to be rented out...WAY more than what the by-laws state.

Yet, they still expect HOA dues every year...is this acceptable and would you pay them?

Better check local ordinances. If you live in Ascension, you are legally bound to paying your annual dues to the HOA

Sorry your HOA is trashy.

Know any other homeowners that feel the same about the HOA not enforcing by-laws and allowing people to get away with letting their property look like shite? Get a group together and send a petition to the HOA demanding them to enforce the by-laws or threaten to stop paying dues and take them to court over it.

Yeah, I feel it's a legit conundrum...on one hand you're paying an entity to maintain and hopefully increase home values which they are absolutely not doing...on the other hand if you don't pay they can seek recourse and legally obtain it

If you chose to stop paying, who's going to maintain the common area's and/or pay the security bill if you have patrols? Paying HOA dues and HOA Management fee's are different. The solution is to get a new management company.

Get a few like minded neighbors together and run for the offices (President, treasurer, etc.)

Then pass whatever rules you think are the way to go.

That's definitely frustrating that you're HOA is not enforcing their rules and restrictions.... have you contacted your HOA board in regard to these issues?

What would be the consequences if you don't pay? Compounded late fees? Would they file a lien on your property? If so, I would recommend going ahead and paying the dues....

It's probably more advisable to sue the board than to stop paying. Don't give them leverage.

Is the HOA even active? If so, why are they not enforcing the rules and restrictions? Too many apathetic residents can make for basically a non-existent HOA or board. If they are aware of the restrictions or by-laws, but are not willing to enforce them, you could sue them. Better yet, get you some like minded neighbors and run for office and then you can be the enforcer. Having been in that position before I know it is a thankless job and most people do it begrudgingly. And I can tell you this much - threatening people with liens doesn't scare them at all. Not one bit.

Most likely, given the likely consequences of not paying them.

Everyone is just saying, "eh I wouldn't pay them, screw that" like the HOA is just going to say ok, no biggie, you don't have to pay us.
