How to find someone and their employer to activate wage garnishing?

I had a shite tenant who was evicted. We spent some money and cleaned it up, sold it, and made a good profit. It's not the end of the world, but the two on the lease have been deemed in judgment for over $5,000.

Any idea how to find them? They both have Facebook accounts, but they appear to be separated and always in different locations.

I'm curious but isn't that for the courts to do? Do they really tell you to set it up yourself? Maybe I'm mistaken.

The court usually sends the garnishment to the employer. I’ve received a few from employees that have them.

Yes, we had a court date and judgment has been given. I called the court and they said I have to find them and they cannot do anything. I just don't really have an idea on how to track someone down.

If you rent it to someone else they aren’t liable anymore. At least not for the months the new tenants are there.

I was stunned when they told me I had to find them. It has made me absolute change my screening process and collecting much more information. So, lesson learned, but it's things like this that cause good people to have higher rates to offset the shits.

A lot of times you are shite out of luck in situations like this, a bad renter can really screw you over.

I think you have to make a separate request to the court for the garnishment. I was going to do that until I learned my tenant was in federal pound him in the arse prison and had so much restitution to pay that I would never see a dime and I gave up.

In Biden's economy, the garnishment won't amount to much per month, and they may even quit that job just to spite you. It may not be worth the hassle for 5k.

I think if you know where they work you can get a justice of the peace to issue a garnishment order to their employer. I had 3 garnishment orders on different employees that all came from justice of the peace.

It can be complicated and get expensive as court cost have escalated these days. If you can’t find his job if you have a good address you can have him served for a judgement-debtor examination. A summons to appear in court and answer questions. This is a separate proceeding. Once you know then you can file the garnishment. If they have only been on the job for a short time or it does not pay much , they will likely quit and you get to start over. It sucks, I’ve been in the finance business over 40 years. Judgement gives you the right to collect but you have to do the collecting and the courts or sheriff department will take a commission also. 6% I think . You can also seize certain assets if you can locate any but again there will be advanced cost to each action . Good luck

You send their employee a note and say "send x amount of _________ paycheck to me each pay period until they have paid me over $5k. Thanks".

This is good advice. If he doesn’t care about his job, the minute his employer is served with an order of garnishment he’ll probably quit and you have to start over trying to get an order of garnishment for his next employer. Probably not worth the costs to chase him down over $5000 unless he has long term/stable and well paying employment.

If you are not running a credit check it's your own fault. If they won't pay anyone else what makes you think they'll pay you?
