I love that he posted it to Youtube and is getting DESTROYED by everyone haha. The video has about 100 "likes" and 4500 "dislikes".

Was this store known for offering sauce that way hotter than is usual and well above safety requirements? Did the guy have to have several skin grafts to fix the damage caused by the dangerously hot sauce?

Mc D had gotten numerous complaints about the water being too hot but refused to take preventive action.- that is one part of the story that gets neglected

A vascular surgeon determined that Liebeck suffered full thickness burns (or third-degree burns) over 6 percent of her body, including her inner thighs, perineum, buttocks, and genital and groin areas. She was hospitalized for eight days, during which time she underwent skin grafting. Liebeck, who also underwent debridement treatments, sought to settle her claim for $20,000, but McDonalds refused.

During discovery, McDonalds produced documents showing more than 700 claims by people burned by its coffee between 1982 and 1992. Some claims involved third-degree burns substantially similar to Liebecks. This history documented McDonalds' knowledge about the extent and nature of this hazard.

McDonalds also said during discovery that, based on a consultants advice, it held its coffee at between 180 and 190 degrees fahrenheit to maintain optimum taste. He admitted that he had not evaluated the safety ramifications at this temperature. Other establishments sell coffee at substantially lower temperatures, and coffee served at home is generally 135 to 140 degrees.

So a 79 year old woman burns herself with hot coffee.

A) she is 79 and her skin is already much weaker than younger person skin

B) coffee was hot

C) she spilled it and burned herself.

I doubt McD was handing out superheated coffee that day. Hot water is hot. Sometimes it burns you. shite happens.

I will give her credit for only wanting 20k to cover her med bills, though

Eta: if McD did not evaluate the heating mechanism, that can definitely be neglect. Maybe I'm just a heartless bastard

I believe the damages awarded were equal to a day's worth of revenue from coffee sales, which was a creative decision (something like $3 million)

In this video the same guy holds everyone up on a train for 17 mins by refusing to show his ticket bc it's his "constitutional right" to not provide it.

Just as a sidebar...this story was greatly sensationalized by the media. As usual, they picked up the story after it was in full scale meltdown and chose to leave out certain facts that would reduce the fever pitch it built up.

Here is what was left out (as a sidenote, I am generally VERY conservative and very much in favor of tort reform): after she burned herself, she went inside (in obvious pain) and complained to a manager that the lid was not securely fastened by the employee who handed her said coffee. She also insinuated that it didn't need to be that hot. Manager blew her off and halfway apologized offering to refund her money. She left and went to the doctor. Came back weeks later with a very small medical invoice asking for it to be paid. Manager sent it up to corporate. Corporate sent the lady a legal letter that essentially told her to go get fckd (in nice, legalese). She took this letter and her medical bill to a lawyer. Lawyer went back to McD's corporate and threatened a lawsuit if the medical invoice was not paid. Again, McDonald's corporate told them both to kindly go fck themselves. Then the lawyer said, "It's go time". And THAT is when they filed the huge lawsuit.

Again, I am very conservative about things like this, but I wanted to make a point that the stories we read in a newspaper or on internet sites are generally about 25% truth and facts. Not that they are full of mistruths all of the time...but facts are omitted in order to keep the story salacious.

McD was heating their coffee to ridiculous levels. The machines were faulty, but they weren't willing to spend the money to fix them all. I'm guessing you've never taken a business law class.
