Benjamin Golden is suing Uber driver Edward Caban for damages after he says he was illegally filmed while riding in the car in Costa Mesa. Golden’s lawyers told CNBC that Caban is to blame for any injuries he suffered during the attack.

Golden lost his job with Taco Bell after video captured by a dashboard-mounted camera showing a drunken Golden repeatedly hitting Caban, grabbing his hair and slamming his head against a window went viral. His lawyers will seek to have that video barred from evidence in Caban’s case against Golden over the attack.

frick any state or jurisdiction that doesn't allow the free recording by private persons of other people either in public or in another's private space

He has no case. There is no way that is oral communication as defined by both the federal and state statutes

I'm sure there's a legit argument, but that doesn't make the act excusable at all, and I would be greatly disappointed if the video was ruled inadmissible in court.

it's like how if i beat you up i'd be facing a low misdemeanor battery but if i threaten to beat you up on here it's a much more serious misdemeanor (and possibly a felony). these states that have anti-taping laws make them serious business

IIRC, the driver tells the guy that he's filming him, hoping that will end the beating. IF there is a statute about filming the unaware, that should take care of it.

what do you do if you can't afford a lawyer for a case like this? That's go to suck, I bet half of the plaintiffs case is hinging on the defendant not getting a competent lawyer due to one costing thousands.
