Do we know the mechanics of where each was? Could he have accidentally discharged, turned to see what happened to her when she presumably screams and Hayes relatively quickly also started firing?

No, it's a crime. But after he left, Hayes was not in further danger. What he did after was all illegal and dangerous. Once he hit Smith, it's a seperate crime and things stemming from that or def because if the actions he took.

Not IMO. The cover up by a witness would be AFTER the death.

Why isn't it logical Smith would arm himself if someone chased him and rammed his car and approached his car?
I don't get this being a big deal as far as a cop moving his gun. Doesn't make the criminal act before just go away.

So I guess my hypothetical to you is....let's say your in a bar and get in a scuffle and hit a guy....you leave the bar and flee. He CANNOT chase you down, ran your car, shoot you, and claim self defense because you feared for your harm and armed yourself with a legal weapon to defend yourself.

Look at the stuff that just happened with the UF guy. At the strip club is one thing....Once they left and he oursuedand was the aggressor, ALL the charges that followed were because of his aggression.

Not impossible if the gun was removed cleaned and the replaced.

Not saying that is what happened but it's possible with the gun not being found until after a warrant was obtained two days later.

Smith gets out of his car, gun in hand. Accidentally shoots his wife, turns his back to Hayes to look at his wife, Hayes freaks out(rightfully so) and unloads a magazine into smith.

Isn't the presumed timeline that the wife was shot first. She was shot in both legs. So he accidentally shot his wife in each leg?

Based on what I've seen to date, Hayes had a .45 and Smith had a 9mm.

It is not rocket science determining the difference between the ballistics.

Chick Foret with WWL TV on twitter reporting that Orleans DA's office brought Hayes to grand jury proceeding to testify without notifying Hayes attorney or getting Hayes' attorney's permission. This would be pretty unethical if true

Come on, hitting from behind does not mean you shoot someone. We do not know who threatened to shoot or shot first.




Well one was intentionally done after chasing him. The other was an accident and they tried to flee.

Not saying who is guilty of what, but those are COMPLETELY different situations.

Didn't Hayes's attorney want Hayes to testify before the grand jury? What's the issue if his lawyer wanted that?
