That is a funny story, but hey he got a designated driver, albeit a drunk one, so at least he's smart enough not to get behind the wheel drinking.

This is the problem. You get a DD and still have to deal with BRPD's antics. Punished even when doing the right thing.

I remember that Facebook page. Honest question though... Is that the best action to take if your loaded behind the wheel, don't answer any questions, deny sobriety test and breathalyzer?

He wasn't behind the wheel. so yes, it's her Constitutional right to do so. The cops weren't going to tell her that.

Yes, he did.

On a traffic stop, an officer can instruct a person to stay back. At that point it is an investigation.

The area the officer is doing the investigation is the scene.

The officer has control of the scene and can order someone out of that scene. Failure to comply is interference or obstruction.

Being an attorney does not allow you to disregard an officer's instructions.
