Does a prior murder in a house have to be disclosed by a realtor?

I didn't kill anyone and I'm not selling a house.

Someone I know bought a house 6 months or so back. Last night, hysterical lady neighbor comes over talking out of her mind with statements like: "they pulled her by her hair; why did you kill her?" Friend replied that he didn't know what she was talking about. She then goes on to say "a woman was killed in that house, and now her spirit won't leave me alone. Yall need a ghost hunter to cleanse that house." Woman was probably drunk/high/possessed. I've searched and can't find anything about a murder there.

If by some chance that did happen, does a realtor have to disclose that sort of thing? Conversely, can that sort of thing be suppressed to make the house sellable?

ETA - house was a foreclosure purchase from bank through a realtor

My understanding is it must be disclosed but not positive.

I think I'd be more worried about the crazy lady living next door than a possible death in the house.

Not sure where you are, but it does not have to be disclosed in Louisiana. Also, even if it did need to be disclosed, it wouldn't go back on the agent UNLESS they knew that it happened.

Yes. I remember that from B-Law in Simon's class. Was one of the more interesting cases we discussed.


eta: TigerRealtor well hell. Was Simon full of shite or the book or what? I'm sure the edition is way up there now but it was in our Book for the Finance class 3201(b law).

I don't believe so unless there is a specific state law on point. Someone asked me about disclosing sex offenders close by. I could not find anything in Louisiana that says you have to. Think about the burden that would be placed on the owner. How can they know if someone was murdered 10 years ago in that house if they moved in from another state 2 years ago? How far back do you go? 10 years? 100 years?

Disclosures for house selling usually have to do with defects and types of materials being used.

I'm not a realtor but I've heard that they have to disclose such information if it happened in X amount a time. Like they would have to disclose a murder in the house from 6 months ago, but not one from like 50 years ago.

Again, I'm not sure if that's true or not but it sounds logical.

I thought I just read somethng about disclosing info about a death in the house when selling- like someone dies in there sleep ofnnatural causes, the family or whomever has to report that to a potential buyer

Not required, if a buyer wants to know that info they can search for it..

Sounds crazy.

When I bought a house, I googled the address and asked if any known criminal activity occurred in the house.

I'm not sure if they have to disclose it like they would a defective HVAC or storm damage.

It's only required to be disclosed in 3 states. Louisiana is not one of them.
