Citations are discretionary in enforcement. Most of us are wondering why a warning, and an educational moment of the law was less appropriate than a ticket and a fine for someone not wanting to be in the cold while waiting for a vehicle to warm up. It's an odd way to be a peace officer in the community.

It was law when I was military and on base. Know a lot of people ticketed for it. Hell, that was just for unsecured and unattended. Did not even need the vehicle to be running.

Situations like this are why so many people hate cops They are always looking to squeeze some more cruiser money out of some average Joe minding his own business.

Any sensible human being who is looking out for the little guy (as cops claim to be doing) would have simply knocked on the guy's door to give him a warning.

Completely agree. And maybe he tickets everyone for this or maybe it was brought up that they had to start doing this. No way to know the particular situation. I know I personally wouldn't go farther than what you said.

Hell you can get a ticket and your vehicle impounded most places if your car is parked in your driveway AND blocking the sidewalk. It is an ADA issue.

That's not a law, that's base procedure. Local law enforcement would have no authority to come onto post and ticket a vehicle for that. Only post MP.

Even Airports it's not a law it's their security policy. and they can have it towed or ticketed. But it's not law. and If I were this guy I would go rent a monkey, put him in a suit and bring him to court and say this is my lawyer that will be arguing this case. unless the guy lives in an apartment or something, no way it stands on his own personal property.

The reason for a law preventing leaving a vehicle running with keys in ignition unattended is to reduce vehicular theft.

Several states have these laws.

I find it interesting that policy for most LEO is to leave there service vehicles running also so that there is not chance of it not starting when they need to go in a hurry.

So this is the situation that I am imagining. Someone at the police department figured that with cold weather people would be running their cars to warm them up and saw this situation as a revenue opportunity. It was then time to go drive around neighborhoods looking for people warming their cars so that they could abuse the intent of the law and extort money from the citizens. In no way can this be spun to be protecting anyone. It is clearly nothing but revenue collection. Really gives LEOs a bad reputation.

My car has remote start and only will do so if it is locked. If someone unlocks the car, the engine shuts off.

And if someone was in the car when I did remote start it and they tried to put it in drive, the car would shut off.

Or not done shite because the guy is warming up his car in the winter on his own damn property.
