It's incidents like these I'm thankful for Anonymous. Hopefully they make this count's life a living hell. I've been injured to the point of having a permanent limp, and you just get over it. No need to ruin a 12 year old's life who was merely happy to see his aunt, especially when his mother just dies.

That would go to her comparative fault and would reduce any award by the percentage the jury would find her negligent as well. Hopefully this count gets zipped and has to pay the defense fees and costs.

My auto insurance got taken for $12k for "soft tissue injury" when my daughter and the "victims" car merely rubbed together on Airline Highway. There was no damage at all to her car other than a little smudge that could be buffed out.

Not on this scale whatsoever. This is just deplorable and evil. You will find just as many of these types of people in the South as you will in the north. This kind of evil isn't learned and just comes from natural instinct. The bitch may be crazy, but any lawyer who takes up this case is evil personified. I just can't imagine what piece of human garbage would take up this case.

It wasn't about her not knowing the coffee was hot, it was about not knowing how hot it actually was. Most people don't expect spilled coffee to be hot enough to cause 3rd degree burns. Also, She was only asking for her out of pocket medical bills and some money to cover her kids lost revenue when they had to sit with her after she had the skin grafts to repair the 2nd and 3rd degree burns she suffered from the coffee. The jury decided to award the 2.7 million after hearing testimony from a witness for the Defense!

My old man put a pool in when I was 12. All of us and our friends enjoyed it that first summer until one friend - who had been in it over 5- times - dove into the shallow end and broke his nose. His family sued - my old man never let another person other than family swim and all my friends hate that kid to this day and that was over 40 years ago.

For this to have reached a trial setting and not thrown out for passing statute of limitations, it looks like the suit would have been filed right around the time the kid's mother died.

The Statute of Limitations is two years for this action (the discovery rule does not apply here):
quote:

Sec. 52-584. Limitation of action for injury to person or property caused by negligence, misconduct or malpractice.

No action to recover damages for injury to the person . . . caused by negligence, or by reckless or wanton misconduct . . . shall be brought but within two years from the date when the injury is first sustained or discovered or in the exercise of reasonable care should have been discovered . . . .

Which means this would have had to have been filed before March 19, 2013. The mother died sometime in 2014. This is a suit against the home owner's insurance, not against some nebulous potential inheritance the kid may have gotten. If the aunt had significant medical bills associated with her broken arm, I don't have an issue with her bringing the lawsuit to recoup those costs. However, I hope the jury kills her "pain and suffering" damages because of her BS "can't carry my hors d'oeuvres plate" testimony.
