Pulling the teams' assets and writing an IOU is not going to hold water, right?
Especially when it looks like the value of the IOU is about 10% of the actual value of the franchise. I think the problem that the trust has is that the growth of the teams is far outpacing any other investment options that could be made with a cash replacement.

This will not really affect the management of the teams I wouldn't think. They run pretty independantly, and Lauscha/Loomis have ridiculous amounts of power while Tom is still kicking.
Yep, and the kids/grandkids are beneficiaries of the trust, not owners of the team. That's a very big difference. Plus, I doubt management decisions are passed onto the trust until after Tom's death. I think the play they are making to have him declared incompetent is to undo their firing. I don't see how their firing can be undone otherwise. Basically, they'll be the beneficiary of the fund, making money from the team, but not be allowed to work for the team.
We need our board attorneys to review my thoughts, though.

I'm an attorney but I've dealt with trusts pretty much never. I really didn't pay attention to that in law school, to be honest.
But from what I've heard, Lauscha will be pretty much "the man" when it comes to running the trust, so in a lot of ways, he will be effectively the owner. That could be completely wrong.

I'm an engineer, but I have been dating an attorney for almost 2 years. That has to mean something, right?

Like I said, I did not pay attention to trusts at all because I knew I would never have anything to do with them, and I haven't.
I just conceded any questions that would be on the bar exam about them.

I'd like to know the full language of the trust rather than the excerpts in the petition.
yeah, I think this will be the only leg they really have to stand on, unless the old man has gone ape shite mad.
If and when the specifics of the trust comes out, please provide your insight.

In the absence of Tom, can we get a Ballmer/Cuban type?
Bill Simmons said if he had $1 billion that he'd buy the Pels
Haralabob also said if he had a billion dollars he'd buy the Pels just to fire Monty

Anyone catch the news tonight? Had a small interview with the kid's lawyer. He completely tried to play the "they are going to move the teams out of new orleans if the kids don't get it card".

On a side note, how the hell did I end up with a stickied thread? Is this real life?

Remember that time Tom wanted to move the Saints to San Antonio? Good times

I R'AD and they listened

Still, it just seems really stupid to put an asset as valuable as the Saints/Pelicans franchises into an irrevocable trust, where the guy couldn't change his mind on ownership after the fact.
