Wow. Good for him. I'm surprised.

Found this article very interesting:

quote:
Interestingly, Syed was granted the appeal in September, before Serial began airing. Syed’s lawyer, C. Justin Brown, asked for a new hearing based on the idea that Syed’s first two lawyers didn’t do their due diligence, leaving potential alibi witnesses unquestioned and failing to argue effectively for Syed’s innocence.
Syed has been appealing his case for about five years now but has, understandably, drawn more sympathetic ears and eyes to his case in the past few months. That attention could have contributed to Syed’s new and expedited hearing, but Brown told ABC that “the appellate courts make their decisions based on the merits of the case, and not the popularity of a podcast.”

It's out. Very disappointing

Just finished the weeks episode. I'm going to have to listen to it again for a full assessment.

There is just no way this guy is getting out of prison. It's nice to think about, but there isn't enough to grant an appeal because ineffective council.

Well he's been granted an appeal hearing for January '15. Also, that innocences firm has gathered enough information to test Hae's body for sexually assault and DNA.
I'm not saying its likely he'll be set free. But I don't think it's impossible.
This episode was the first that I linked to with HBO's "The Wire". It's crazy how many people had been affected by crime during that time in BAL.

I was wondering if it was a convenient excuse for some to get out of jury duty to be honest.

I could see it happening from time to time.
This episode actually pissed me off to a certain degree. The whole "Adnan is a flight risk" angle is such complete bullshite. Just another layer of ridiculousness is an already bizarre story

It's amazing about how people can sit on a jury an let their prejudices and feelings enter into a trial where logical thinking is the most important thing to have.
I would be scared to go in front of a jury for a murder charge even if I didn't do it. There are some real idiots that get picked for jury duty.

I find that pretty ridiculous as well.
It's also disturbing that Adnan's on teachers were skeptical of his background. It wasn't like he was an outsider/loner type of student. You would think people who taught him wouldn't be so prejudice of his background.

As much as I don't like Cristina Gutierrez's style of presenting this case. I don't think she completely threw this case. Unfortunately, it seems like she had to fight two battles with this case. 1.Proving that Adnan had nothing to do with his murder. 2. Educating the jury on the muslim culture and how Adnan was an American with Pakistani heritage.

Id like to point out that there are 2 types of spoilers. Talking about the episode is one and im cool with that. Doing research that tells about stuff that is out in front of the episode is not cool.

What a podcast this has been.
I've never been more on the fence with anything in my life than I am about this case. One minute I think Adnan did it, and the next I'm saying no way.
The most mind-blowing and upsetting part of the entire thing to me is how this jury convicted him in less time it takes to go get lunch. That is so irresponsible by every member of that jury. You don't put a man away for life that quickly and especially since this wasn't even close to a slam dunk. I blame a lot of that on Christina. I don't think she purposefully threw it or any conspiracy like that, but I think she completely blew the cross on Jay. Her style and methods didn't work at all and the jury straight tuned her out IMO. I was the foreman of a jury once, and the things people say back in the deliberation rooms is scary. A lot of stock is put into the "performance" of each attorney and how they treat the witnesses. This jury (I'm not sure of their racial makeup, but that's very important) was forced to listen to some woman yell at a poor black kid for days and days, and I think that had a huge impact.
ETA: To add, I hope Sarah spends the remaining episodes focusing on corruption and our legal system. We've heard enough about the minutiae of the case. At this point we won't learn anything new unless someone has some shocking information. It's pretty obvious that the cops desperately wanted to pin the body on someone and this entire thing was rushed every step of the way. The police and the legal system were grossly incompetent, and every week I listen to this I feel more and more like I'm involved in a real life Wire episode.

And just to clarify on the "Adnan is getting an appeal hearing" - that's not accurate.
His appeal for a hearing on ineffective counsel was denied. He appealed the request for a hearing to a higher court (Maryland Court of Special Appeals). The higher court sent ONE portion of his argument on ineffective counsel back down to the appeal court.
Sarah clarified that at the end of this week's podcast.
So, yes, the appeals court will consider one portion of his claim of ineffective counsel, but he has NOT had a appeal hearing granted. They are asking the state to respond to the ineffective counsel claim and then the appeals court will decide if Adnan gets a hearing.
