Face it, he got a happy ending.
I suppose it's open to your own interpretation, but the actress that played Max said he's dead in an interview on afterbuzz.

I wanted Flint dead. Screw this happy ending crap.
Flint did die.
So - the whole four seasons came down to a dead Flint giving his phantom boy friend a long lingering kiss.
I liked this show a lot; I watched every episode. And for my trouble I had social commentary shoved down my throat.
At least it wasn't Toby Stephens' tongue.

I mean, I guess you feel that way, but I never felt like it was being shoved down the audience's throat. There was every type sex imaginable in the show over the 4 years, so I don't know that it was their intention to promote any specific commentary, but I don't spend much time considering what social agenda a television show has. I just thought it was an interesting and surprising way to solve the difficult question of motivation they had to answer. For Flint to have been so driven to the point of borderline madness, there had to be a damn intense backstory to explain why he was so single-minded in his rage for vengeance at the expense of his own well-being.

I strongly believe Flint did not die. In the end, I was able to look past the gay angle and actually appreciate the his character arc regardless of his sexuality. But the amount of time spent setting up Silver and Flint's friendship/respect, and the amount of show time that was spent ultimately dealing with the consequences of their friendship, I just do not believe that Silver killed Flint.
For one, why the trouble sending soemone to inquire about the place in Savannah. Next, from Treasure Island, we are led to believe that Flint survived his experiences from Black Sails and lived on for a time.
I think that they came to a conclusion that would allow all of them to be happy: Flint's desire for the cache was nothing compared to his desire to have someone dear lost to him return. He would gladly give up the location of the cache to Silver without a fight. Silver knew this. Silver's plan was likely to satisfy James McGraw, so that the monster Flint could finally be laid to rest(literally said to have been killed in the show). With the personality of Flint no more, McGraw had zero desire to remain on the account and rage all out war against England. He may have wished bad things to England but his primary motivations were reduced significantly with the news of Thomas. This is what I truly think happened.
Treasure Island happened years down the road because I do believe that Silver saw the benefit of waiting for a significant amount of time to pass before he considered retrieving the treasure. This would allow him to spend his time with Madi, be a family man for a while, before returning to find the treasure once all of the attention had disappeared/died off.
Oh, and about that pistol shot in the jungle. Well, you know the endless potential of Flint and Silver together. They could have just as easily fired a shot to feign the appearance of Silver shooting Flint.

I know right? I just assumed Silver fired off a shot to get their attention or something. That kind of pisses me off.

Well, I rewatched that scene about 5 times and there is no gunshot...the birds fly and the men waiting start walking but if the director really wanted us to think Flint was shot, he did a bad job of conveying that to his audience.
I think the actress in the interview is wrong. Happy ending and Dottie dropped the ball on purpose.

I believe that Flint is alive. Why would they set up everything to coincide with TI but kill Flint? This write up does a good job of explaining what they think happened. It is a Tumblr post, but it is well thought out.

I don't think silver shot Flint either for the record. Too much time spent on their story as friends. Esp at the end.

A little off topic, but did anyone else not realize the guy that played Rogers was the same guy who played Arthur Dayne in GoT during the Tower of Joy scene? Damn, dude was more badass than I thought lol.

I thought Season 4 was the worst. It was a chore to get through. They tried too hard with dialogue/serious moments/ strategy. I just wanted to see Pirate stuff. Hated the ending but after limping through the season, I expected it
