Berman has given himself until Friday to rule but he thinks he will be giving that ruling either tomorrow or Wednesday.

Berman has continued to push for a settlement, saying it would be "rational and logical," but he also cited weaknesses in the NFL's handling of the controversy. The judge has also suggested that the league's finding that Brady was generally aware that game balls were being deflated was too vague.

At a court hearing this month, Berman told the NFL there was precedent for judges to toss out penalties issued by arbitrators.

Ruh roh, whomever wrote that article is about to get the Bill Simmons treatment.

No settlement means this is just going to continue to drag on for another year or so as it goes through the appeals process.

The NFL really should kick the Patriots out of the league for going to the courts over this.

Brady's team has been all in from the get go. IDK if the judge will rule in their favor as the precedent set will be huge. However, if Berman vacates the suspension and this goes to appeal? Can we all just get to football?

From what I heard, it's either a 4 game suspension or nothing

I believe Goodell was willing to reduce the suspension if Brady admitted culpability in his roll in the events leading up to the AFC Championship. Brady has maintained his innocence from the start.

Saying federal judge David Doty should have deferred to the league's collective bargaining agreement, and arguing that NFL commissioner Roger Goodell had the authority to levy whatever suspension he saw fit, the league asked the Eighth Circuit Court of Appeals to overturn Doty's Feb. 26 decision that vacated Minnesota Vikings running back Adrian Peterson's suspension.

That was for a settlement. Judge has to rule all or nothing.

If the NFL wins, the story becomes does a court issue an injunction to allow Brady to play until the appeals process is complete. That could mean he plays the entire season even if he loses in this phase.

The precedent is far scarier if Berman doesn't rule for the nflpa. Goodell can say he can suspend anyone he wants for any length and continue the sham of an appeals process.

I'm not so sure that's an "everybody loses" scenario. Goodell would take that deal in a heartbeat.

Actually if he does not rule for the NFL then every arbitration case in America would be overturned and people would flood the system.

The NFL has this won, they tried to give Brady a way out, the judge has tried multiple times and he did not want to do so.
