Question About EBR Property Tax

I just received my property tax bill a few days ago and it says it was due on December 31, 2016. It wasn't sent to me until well after that date. I do not have a mortgage so there is no escrow. I pay the bill myself in full by check each December.

1) Has this been a common thing in EBR to get the bill after the due date?
2) Can the payment still be deducted on 2016 income taxes even though the payment was not made until January 2017?

I assume it was late due to the flood. I live in Denham and received my property tax notice yesterday. Although mine had a February due date. I assume you'll be fine paying it now without penalty but maybe a call wouldn't hurt.

You deduct the taxes in the year they're paid so you'll have to wait for your 2017 taxes.

The bill says they won't charge penalties until February 1st.

It's bullshite that they didn't send the bill out until after it's due. Would have been nice to have the deduction for 2016. They should have sent it on time and provided the option to pay late if desired.

Yeah I'm a little annoyed I can't take the deduction this year. I'm getting married in March and may not have enough deductions to itemize in 2017.

I just called the tax collection office at the EBR Sheriffs Office. The woman on the phone says the due date has now been pushed to February 28th.

She would not or could not answer the question about deducting the payment on 2016 income tax. She told me to contact a "tax expert".

The Assessor reassessed property to take into account the August flooding. That process was not completed in time to allow for the bills to be "sent on time."

The fine print says due Dec 31 or 30 days after it was mailed to you.

My property didn't flood either and, yes, it was reassessed upwards,pretty significantly.

As I understand it, the houses that flooded were reassessed down and houses that didn't were mostly reassessed up because the value of those houses increased because they didn't flood.

Mine did flood, and my tax bill still went up. They blamed a reassessment year.

They are laying it all on the flood as far as the timing of the bills. It does suck but there is nothing you can really do about it. I think Livingston hasn't even sent theirs out yet.

I got mine Tuesday.

Also, why can't you take the deduction for 2016? I spoke to a CPA and one of the things we discussed was making sure I received all aid and finished paying for repairs prior to filing so that we can get the most correct number for a loss deduction. This would include money paid/received this year. Does this not work similarly for the tax assessment?

It does work the same way.

You will be paying the property tax in 2017, not 2016, so you can take the deduction for 2017.

The tax is deductible not in the tax year the tax is assessed but in the tax year you actually spend money paying the tax.

This is highly questionable and splitting hairs, for years the check is written in December but not cashed until January with no problems at all. the 2016 deduction should probably be taken on your 2016 taxes, not an expert, ymmv...

Luckily my CPA sent out an email to remind us to go to the Sheriff website to pay it online for this exact reason. He wanted to make sure we paid in 2016 or it could not be part of 2016 taxes.
