I feel so helpless and not sure what my advice is for them to do. They haven't signed anything but the company has been bending over for them about getting their car fixed.

You can let them pay whatever to fix the car, and not release a personal injury claim.

I don't run in PI circles much, but do dabble since cases do walk through the door. That might be coming to an end since I am facing less and less time to handle stuff like that.

Thanks what I'm thinking too. I hate ambulance chasers as much as the next guy but sometimes there is a need.

Act on this impulse. This is the exact situation where they shine.

(And I know, I was one in a previous life. But, I was one of the moral, ethical ones - a rare and vanishing species, indeed.)

Sucks for your parents, but at least the at fault party will have adequate coverage to cover expenses.

I was recently rear ended and didnt start hurting til 3 days later, and it has worsened for three weeks. Turns out I have s compression fracture in my upper back. Hopefully my bills will stay below $15k.

I'd definitely lawyer up. Find out the fees because several of the ones they advertise a lot will rape you with fees.

I am not certain how big companies pay their claims but I will share with you my experience with EXXON.

I was at a red light in Gonzales when an Exxon employee in a company truck hit me from behind. I was not injured but had $3600 damage to my new vehicle. I did not sue them or receive any other compensation just the repairs to my vehicle.

Exxon did pay to have my vehicle fixed but 2 years later I received a notice from the IRS that I did not claim the 1099 on my taxes. I had no clue what they were talking about since I had never worked for Exxon. After much research, it appears that Exxon sent a 1099 to the IRS for the money they paid to have my vehicle repaired.

So I had to pay federal taxes on the $3600 they paid to have my vehicle repaired. After months of arguing with the IRS, I just went ahead and paid it.

Like I stated earlier, I don't know how big companies process their claims, so just make sure you don't have to claim the repairs to the vehicle as income.

The fact that there are injuries to an unknown extent is enough reason to get a lawyer.

THEY HAVE LAWYERS FULL TIME!

Not being an arse, but you would be simply ignorant to not hire an attorney. The fact that you're asking here is scary enough

First don't settle anytime soon. You don't know the extent of your mothers injuries. Second, most attorneys charge less than 40% if a case is settled out of court. Third, you don't know what a decent and reasonable settlement is. An attorney that does this everyday does. Lastly, there are no slam dunks. There's always something that complicates a case. Lawyer up.

Your question has been answered. Go forth and lawyer up! Its all good and well to call attorneys scum and ambulance chasers when you don't need one...
