This acquisition of Activision is starting to look worse and worse for Microsoft. More skeletons are coming out by the day/week…




That first comment is a Steve Jobs video. One thing he says is:

“The problem with Microsoft is they have no taste…. They don’t have original ideas and they don’t have much culture in their product.”

On point, Steve.

Microsoft knows Xbox is a loser console so they resort to this. Not shocked.

In reality, the FTC has proven absolutely none of the points it needs to prove to get an injunction here.

Florian Mueller is an expert on these sorts of things, and he addressed that email that was filed with the court today here.

The specific context for "go spend Sony out of business" is Game Pass, i.e. subscription services, and it's unclear whether he meant consoles as well, given that he expressed concern over "Tencent, Google, Amazon, or even Sony" (i.e., Sony being less of a threat than the three other companies) becoming "the Disney of games" through acquisitions. It's only in the multigame suscription service context that Sony is more of a concern because the others didn't have one yet.

The email falls far short of a specific plan or evil scheme. It's just the way one exec--and he's not the one who would make that kind of decision--views Microsoft's resource advantage over Sony and the need to act before similarly deep-pocketed players might acquire a lot of games content.

That email fails to meet various of the requirements for a smoking gun. It never resulted in any particular action, it was written more than two years before the Activision deal, and for all of those reasons it's just a distraction in the current context.

Wrong. They buy companies because it is cost prohibitive for them to pay for exclusives the way Sony does. MS feels they can justify buying companies, which comes with actual assets, but says they can't justify just paying for a game to go exclusive because Playstation's larger market share means this would be much more expensive for MS than it is for Sony.

This was addressed in court last week and the judge ended up cutting off the FTC lawyers on this point because this point doesn't actually make sense.

Everyone will just stick their head in the sand if that means more games for their Gamepass subscription.

Phil can’t even confirm what platforms ES6 will be on in the future.

But he can promise COD on future Sony platforms? Wasn’t Bethesda bought for the exclusive rights to only be on Microsoft platforms?

So which is it?

So basically Microsoft is the video game version of Disney. Just like Disney turned Star Wars and Marvel to shite, Microsoft can do the same with Elder Scrolls, Fallout, and the other franchises they've bought.

He testified under oath that COD will be on Playstation if Sony allows it.

The FTC lawyer got shut down by the judge on this point as well, because the FTC lawyer was trying to get Phil Spencer to testify that they would put it on Playstation no matter what the terms of the agreement are (basically, give it to Sony for free). The lawyer also tried to get him to commit to this for all ABK titles (which he couldn't do because WOW and mobile games) and then just Diablo titles. Judge got irritated at this line of questioning. There is no competition concern here.

Because we don't know what platforms will exist at that time. Personally, I think they should make it exclusive.

Loser console but not a loser company. Sony can win the battle of the consoles but if Microsoft really wanted to they could bury PlayStation by outspending them.

Yes, this is literally what they said they have to do to compete with Sony, because paying for exclusives isn't possible due to Sony's large console market share.

Based on testimony last week, MS seems to believe the next generation consoles will release in 2028.

After finishing annual compliance training last week, that statement appears awfully anti-competitive.

You NEVER put statements like that on paper or in an email, even if you are joking.

I mean, that's sort of the kind of thing they're doing with ABK, but that isn't the motivation.

Phil Spencer testified last week that mobile gaming was the main motivation for this purchase. MS sees that as a huge hole in their portfolio. They want to open their own app store. There was testimony last week that they were in final talks with some other mobile game creator (don't remember the name) a few years back but backed out because they believed they needed to buy a larger mobile presence.
