I don't really want to get involved with this part of the argument, but I think he's saying Texas is a red state that likes to beat their chests at small government and minimal private market intervention. Whether that is true or not, the conservatives from there maintain that line.

Some growler places shrink wrap the tops. I wonder if that is considered packaging as well? Alcohol laws make no sense.

Everyone who deals with beer/alcohol in Texas knows that the TABC is the biggest collection of puckered up assholes in the United States when it comes to beer laws.
I can't believe one of these places with crowlers didn't call/email ahead of time and say "Hey, Are you bag of dicks going to be ok with us purchasing this $3K-$5K contraption and canning draft beer to go?"

i thought the original snark about Texans was dead on. Key thing is that in virtually every state, the liquor lobby is strong AF, and keeps a tight rein on maintaining their near monopoly. Who do you think provides all that free alcohol to Legislators during the Session?
Speaking of, in the pit of Liberal hell known as California, i can go fill my Growlers in Petaluma with the latest Lagunitas deliciousness anytime, or Pliny, if i feel like standing in line for an hour. Or i can go to Hokus Pokus in Ellick and fill a growler, no problem.

Folks with puritanical attitudes about alcohol and the big-brewery/distributor gang are the driving forces who oppose efforts to loosen up laws and allow small businesses to sell their customers what they want.
The craft brewers in Alabama formed Free the Hops and have succeeded in passing major changes to that state's backwards laws. They still have room to improve, but they have made major strides. LINK
Maybe LA and TX brewers need to form similar organizations (if they haven't already) to lobby for sensible laws that help local businesses.

I know a couple LA brewers went up to DC to do some politicking a few months back.
