Tennessee's new "gun free zone" law.

What do yall think about this? Will it hold up? Goes into effect on July 1. We'll see, I guess. LINK

I don't speak lawyer.

Only thing that I got out of it was if a business says a CC license holder is harmed on a business property where they are banded from carrying then they can sue the business if they are injured?

Tennessee has been expanding (or really giving us back) our gun rights a good deal lately. Maybe a month ago a law was passed allowing Faculty with a permit to carry on university campuses.

Basically. My understanding of the law is that if a private business that is not federally required to be gun-free elects to go gun-free that if anything happens to the legally disarmed individual that causes recoverable damages that the individual can sue to collect the damages from the business.

An example of this would be I, having a concealed permit in Tennessee, go into a coffee shop that has a no guns sign and I have to be disarmed to enter the shop and a robber comes in and shoots me in the leg. All of my medical bills, rehab, emotional damages, etc can be claimed from the coffee shop.

I agree, they shouldn't be responsible bc they don't make you go in there. You know the rules and you choose to go in.

I'm a huge gun guy and ccw holder, but I'm also about personal responsibility

Been thinking about this and it may get struck down, ultimately. On private property, your first amendment rights are restricted. Will the courts interpret the 2nd amendment rights to also be restricted on private property? I see both sides of this. Do I have the right to tell someone they can't have a weapon with them on my private property? Or do their 2nd amendment rights outweigh my private property rights? I just don't patronize gun free zones whenever possible. I'm not happy or comfortable being a potential target in a target rich environment.

I am currently lobbying some La. Legislators to file a similar bill whereby the business entity(with an occupancy greater than 25) that bans firearms on the property, the property owner is obligated to provide armed security at a ratio of 1:50 armed security to occupancy.

sure, you can sue anyone that you want for anything that you want to sue for...

flip side of this is that if someone who is carrying harms someone in a business, then the person who is harmed can sue the business owner for allowing CC into his business.

it really is a no-win situation for business owners.

So state-specified gun-free zones still exist and this just refers to private property? Well that kinda sucks...

I'd much rather let responsible people carry than rely on some rent-a-cop to protect me.

Just as dumb - small business owners can't afford armed security. We should be pushing efforts for permitless CC and not worry about impacting the local business' because they post as a no gun zone. There are lots of business' that allow CC and open carry that you can spend your money at.

I hope you're joking.

Private property is private property. Nobody is forcing you to go there. If you don't feel safe, don't go there. We absolutely do not need the government passing more regulations to protect a different kind of precious little snowflake.
