Denver 7 News

quote:

The measure would allow a judge to order that a person’s firearms be confiscated if they are deemed a risk to themselves or others. The request for a protection order would come from law enforcement or family members. A judge could place a temporary order for up to two weeks on the person until it is decided at a hearing whether a full protection order is necessary. A full protection order could be approved for up to 364 days.

quote:

As of Monday, 34 counties and towns or cities had passed resolutions in opposition to the red flag measure or declared themselves “Second Amendment sanctuaries” in an effort to stave off the possible law. Most of the sheriffs or county commissions have passed such declarations or resolutions in protest, saying the measure is unconstitutional. Denver and Aurora’s police unions have also said they oppose the measure. Weld County Sheriff Steve Reams has said he will go to jail before he enforces the measure, should it become law.

Blue Senate, House, AG, Sec of State, Governor..... fast tracked this bill through state legislature, just like the anti-oil and gas industry bill that will probably be sent to the Governor’s desk today as well.

Colorado is now worse than California and New York.

A little more about the bill.

Denver 7

quote:

The bill would allow family members and law enforcement to petition to a court to have a person evaluated to see if they are an “extreme risk.” If a judge finds that person does indeed pose such a risk to themselves or others, they could grant the protection order which would allow for that person’s weapons to be confiscated for a period of time. This year’s measure carries differences from last year’s bill, however, which stemmed from discussions with courts and law enforcement, Garnett said. The 2019 measure doubles the amount of time that a judge would have to consider appeals from seven to 14 days, and from 182 days to 364 days for the full extreme risk protection order. The burden of proof for a person deemed an extreme risk would shift to them when trying to get a judge to terminate the order, though the initial burden of proof to get an order granted lies with the person petitioning. A judge has the discretion to allow respondents multiple chances to get the order lifted, and respondents would also be provided legal counsel at the expense of the state -- another change from last year's bill.

I am sure that the people of Colorado do not care that they are "Worse" than New York or California as long as they do not have mass shootings to worry about.

Colorado is not worse than California. There is already a filing to fight this signed by the majority of county sheriffs. Sheriff in my county has done numerous town halls calling this a 2nd Amendment Sanctuary county lol. This will die. Boulder and Denver can frick themselves and leave the rest of this great state alone.

The police almost anywhere you go have no desire to add this to their long list of task.
Taking away peoples guns legally or not is a dangerous damn job.

Whatever... Will get this to the SCOTUS and be struck down. It is FAR better for we true patriots for this to be happening while the court will reject these bills.

Folk like VOR and champions of stare decisis will then support the SCOTUS upholding the 2nd amendment forever which is awesome!!

Ok someone help me out here:

The florida school shooter had multiple fbi complaints/tips etc that he's crazy and planning a shooting and they did nothing. Obviously they should've done something proactively before it was too late.

that's a legit person to strip weapons from.

Now: who's to say/define going forward who is "at risk" in Colorado? How do we know this won't be abused?

IF someone is "deemed risk to themselves or others" they should be directly committed to a metal health institute. At which case they would not have access to fire arms.

by the same measure, then they should have their drivers license revoked, and car impounded, and their voting ability removed. If they are mentally unsafe, then they should have other dangerous abilities removed

It would be much more effective to put the crazy person in a hospital where they cannot hurt themselves or anyone else. But to do this requires some due process and that is not their goal.

If they take his guns, he can get another. If he is in a padded room he cannot.
