I bought some furniture for a media room a few months ago and negotiated free delivery up front or I'd keep looking. No way I was carrying that heavy crap upstairs.

You should just be thankful that your chair didn't cause a bigger accident. Next time, check your load. This isn't the fault of the furniture store.

As far as I'm concerned, they loaded it, they tied it down. I am out my money and have one severely damaged chair. I think they should either refund it, repair it, or replace it with same chair.
This is really close to the mentality of a certain subset of American culture. It sucks, but you gotta take personal responsibility on this one, chief. Learn from your mistakes and get it delivered next time, or invest in some ratchet straps.

I'll play. I won't get into who's wrong or right, you asked how to get it handled. Find the highest ranking person you can. Send articulate email with all the facts. Stay nice! No one wants to help an A Hole. Tell em you're a loyal customer, plan to do business in the future, Yada yadda. Request a mutually beneficial solution. If that doesn't work, start a BBB complaint. Last resort small claims. Basically dont go nuclear when small arms could work. I have had alot of success dealing with companies this way. At the end of the day it's business, treat it as such.

How on earth did that chair get over the tailgate again? You could have killed someone.

I wonder who the lawyer of the family of the deceased would have blamed?
Him, the loaders, the furniture store,, the highway dept, the rope manufacturer, the salesperson, the truck manufacturer, the state, county, his momma, his daddy, his doctor

Sorry, but you are the dumb arse that didn't make sure it was secured.

The chair jumped out because it was so F'n ugly. Consider yourself lucky you get the chance to pick out a different one. That thing almost ended up in your house, man.

Its your vehicle, your load. You're responsible for both.
Be thankfulnyou didnt kill someone.
Learn and move on.

You really should lawyer up and sue the crap out of the truck owner.

I think you lucked out because that is an ugly chair.

This DEFINITELY did not go like OP would have hoped.

I work in the corporate office of a furniture company. I guarantee you signed something that released the store from liability. Now, if the store was worth a shite, they would replace your chair and either write-off your loss, or (if they do enough volume in sales) tell the manufacturer it was damaged and have them part it out.
But, if you went to some nickel and dime place that has good prices then you're probably just fricked since they can't take the hit monitarily to replace the chair and eat the cost of trashing the one you willfully drove off the lot with.
Moral of the story: bring your own tie down straps like a real man. I'm always surprised when I'm at our stores that people will tie up a $5k couch with the little nylon string we have and think that's sufficient.

You let the furniture store tie your expensive furniture down with some nylon rope?
No way I would've drove off like that. I would've been adding ratchet straps. That's on you.
