A federal appeals court panel in Virginia became the second one this summer to strike down a state ban against same-sex marriage Monday, making it more likely that the Supreme Court will settle the issue as early as next year.

The three-judge panel of the U.S. Court of Appeals for the 4th Circuit in Richmond ruled 2-1 that gay men and lesbians have a constitutional right to marry that is paramount to state marriage laws. The ruling affirmed a district judge's decision rendered in February.

"We recognize that same-sex marriage makes some people deeply uncomfortable," said Judge Henry Floyd, originally appointed a district judge by George W. Bush and elevated to the circuit court by President Obama. "However, inertia and apprehension are not legitimate bases for denying same-sex couples due process and equal protection of the laws."

This is the 2nd circuit court of appeals in a row striking the ban down this year. It's clear that it's over and fat lady is singing right now. It's only a matter of time before its legal nation wide. shite, there's a federal judge in New Orleans entertaining it as well.

The courts aren't beholden to the will of the people. They never were. They're beholden to what the U.S. constitution says on the law and interpret it as accordingly.

State law should supercede the US Constitution?

I had no idea this ruling would come down today... just happened to find myself a while ago in the middle of a big crowd in front of the 4th Circuit Court here in Richmond as I took my daily walk. What a great time!

Wished I had my Maggie head with me so I could carry a protest sign saying BESTIALITY IS NEXT.

And some of you still doubt that Rex is probably the greatest living troll.

Yet, the "post reply" rate will prove you right once again.

Well, "marriage" was viewed as a fundamental right by the founders, but I'm sure they wouldn't have agreed that it was an unlimited right which included homosexuality, polygamy, or any other form that many are proposing as acceptable today.

North Carolina's AG just announced he will no longer defend that state's ban after the 4th Circuit ruling today. Bans in West Virginia, South Carolina, and North Carolina will now almost certainly be struck down because of this ruling. (these states are in the 4th Circuit's jurisdiction)
