You wouldn't have to take a field sobriety test unless they think you are impaired.

And how would they "think you are impaired" ?

Many officers don't conduct the fst's correctly.

And it will work in the drunk's favor if he/she takes it to court.

I'm for anything that saves lives cause selfish douchebags decide to drive drunk. If people were more responsible, things like this wouldn't be needed.

I'm sure you'll open your house door to every police officer that passes too. I'm sure you have nothing to hide. It will help them do their job.

Speech, smell, and I would assume just the obvious shite like an open container somewhere in sight.

Well, let's see: Open container, evading the road block, smell of alcohol in the car, puking out the window, saying hold my beer, etc...

Go out and celebrate freedom with some drinks and friends, then have to cops violate the 4th amendment on the same night.

I love Amerikka!

Not necessarily. Chances are the person will still get convicted. Your chances may be good on appeal, but that's more money you have to pay.

So what happens if I assert my 4th amendment rights to search and seizure and decline the officers invitation to blow? Even if I have no drinks?

I still get the needle, and my license suspended. Keep up the good work guys.

And how would they know any of this unless they stopped someone's vehicle and conducted a search??? Without a warrant I might add.

I certainly don't think that, but there needs to be a limit on how far the cops can go with shite like this.

Don't worry the magistrate is there to give a warrant for everyone. It's legal.
