I'm talking about if it is in plain view. An example would be an open beer sitting in a cup holder that could be seen though the window. I know a guy who got hemmed up from that.

Nope. We've got Uber and Lyft in Memphis. It's a pretty neat concept, but I've yet to try it. The cars are marked with large pink moustaches that attach to the front grill. They look hilarious on the right car.

It would be interesting if a libertarian/ACLU like group decided to plant a large number of people as drivers in these checkpoints.

Although the discussions always center around public safety my suspicion is the motivation is for department profit. If this is the motivation, then the department having to pay to BAC test a large number of sober people would make it costly rather than profitable.

if i'm traveling I shouldn't have to prove that i'm sober.
and after refusing, no one has the right to stab me with a needle against my will. that is assault.

if you are driving in a strange fashion then I think it would be reasonable to test for sobriety. I think the opposite is true if the police or others stop people at "random". That is probably going to be inconsistently done and amounts to unreasonable search and seizure IMO. I think the search is reasonable if you are driving like an idiot.

Like I argued above, if this is really about profit then the thing to do is to have a large number of sober people refuse the sobriety check point and force them to spend the money performing a blood alcohol test.
