Yes, immigration officers are duty bound to follow the law
If their orders are to stay in the office and do "paperwork" as thousands of illegals stream across their coverage territory, they will do the paperwork.
If their orders are to document detention of an illegal, then release him/her, that is what they will do.

I don't get why he loses his land if they change the borders to Ok.
TX can't deed OK land...Your neighbor can't sell your land to Cptbengal.
quote:
IF the border's change then wouldn't OK have to recognize his ownership of that land previously under Texas and just file paperwork to give him a deed for the Ok portion? Then he would pay property tax to Oklahoma?
They could, but the property owner that was deeded land by OK up to the state boundary might object...or in this case if the FED had land rights prior to OK being a state that ran up and to the state boundary with TX that ownership would be superior.
quote:
I don't get why he has to lose his land just because a state border changes. What if say the Colorado splitting into 2 states were to happen? Would all of those property owners in the new state have to give their land to the BLM since the Colorado deed would no longer be valid?
You're confusing the issue. First, here, the state border isn't changing - it has never been settled. If CO split into two states the prior land deeds would still be valid in both states - you're making an apples to oranges comparison. And the BLM isn't the driver taking land...the border resolution between the two states will be "taking" the land and the BLM (like other OK landowners) may be a beneficiary of that border settlement.

That makes no sense at all. That would be like Wells Fargo and Regions bank merging and telling you they didn't issue you a new account. Then telling you that they had to send your money back to the Federal Reserve.

how can they justify taking his land without adequate compensation?
My friend bought the land in 2011. Paid for all of his acreage, deeded, taxed, etc... Now they are changing the border. They claim the Stateline is the southern most vegetation line of the river. They keep trying to push it further and further into Texas. Originally, it was damn near all of his acreage and since they have backed off a little. Now it is 107 acres closest to the river. 107 acres (current prices are around $2k/acre)they just want to take.

Considering that this state border issue has been going on since at least 1997 and still isn't settled he didn't seek some contractual protections, warranties when he bought the property?

Why? Have we turned into a socialist state. Do you share your earned money with others? It does not matter how much he has. It belong to him, it has been his family for a hundred years.
And how much experience do you have ranching? Do you have any idea how much acreage it takes to support one cow?
I don't see the post now, but this is in answer to the person who said no one needed that much land. He should share it with others. Redistribution of wealth, hmm, where have we heard that?

quote:The law in question is open to interpretation. The BLM has chosen to use a different interpretation than it has used in the past. Otherwise the BLM would have pursued this course of action 30 years ago. So the beef with the BLM is valid. Shouldn't citizens be able to rely on the government to be consistent in its application of the law from one year to the next?
The BLM is duty bound to follow the law. Vilifying them only makes you look like a petulant small-minded fool.

Is it BLM that is pushing this...or is it coming from higher up within the Department of the Interior?

Does the government need this much land?
Of course not. Unless it's being used for a military base, a federal courthouse, a prison, or something like that (and no, national grasslands, parks, or forests don't count--there is NO Constitutional basis for them), the lands should be turned over to the states. Let them use the lands for their purposes or sell them to the highest bidder.

It's blowing my mind that Libs are in here defending the BLM. I guess this administration can really do whatever they want without fear of their own base turning on them.
I just don't see what argument there is to make for taking private property without compensation or a specific government use of the land. It's illegal and unprecedented. The border dispute is the fault if the Govt and should be settled without taking any land. Settle the dispute and then issue the necessary deeds to the people who own the land on each side
