It'd be akin to getting on a freeway in TX and not assuming that the traffic will be moving at 80+ even though the law says it shouldn't.

Knowing people will do it isn't the same as assuming the risk. I know people will murder others. It's not a risk I assume by simply waking up everyday.

that's the chic thing to say, but not true, it's still possible to get one "fixed," although that's not the correct terminology, I'm not saying it's right, but DA's in two Parishes close to where this occurred, are fraternity brothers of mine, and these Parishes are permeated with attorneys that are also my fraternity brothers, again, not saying it's right, but I've seen them disappear

I disagree. After about 8:30 or 9PM, I assume anyone weaving or drifting in their lane is someone that I need to be ready to avoid. It's a fact of life no matter how many frick yous the other guy says.

But it is one when you drive at night.

I've read somewhere that it's estimated that over 50% of the cars on the road after midnight are driven by intoxicated drivers.

It's a risk you assume by driving late at night.

It's called pretrial diversion or article 894 and anyone can do that without connections

Oh... maybe I was a umm... tad bit over the top, so to speak, in my other post. No offense intended.

I don't think that it necessarily should be an assumed risk. I think that anyone who drinks and then drives should be thrown under the jail, for potentially endangering me and my family. But I also realize that it doesn't work that way, I would just hope that I am lucky enough to survive the apparently assumed risk I take by driving. If you'd ever had a family member t-boned by a drunk a-hole driver, you'd know from where I come.

That kinda proves that it is an inherent risk that shouldn't be ignored, no? I've been lucky enough to not have direct experience with a drunk driver injuring my family, but I'm not gonna act like they aren't out there every night either.

I think it' accurate after 10PM in college towns at the very least. It's one of the reasons I think the 10PM drink special law in BR is so stupid. It encourages people to drink as much as they can before 10PM, then they get on the road early enough to still share the road with families heading from dinner or a movie etc.

not condoning drunk driving, but there as many idiots on the road, sober as judges, or more, than people drinking and driving

ETA: or MADD doesn't exist where you live because we bring the DA hunting & fishing a half dozen times a year and talk about this regularly

Similar to my case. I got hit by another driver in BR back in 1999. I blew .13 (limit was .1 then). I completed 40 hrs comm service, MADD class, everything else judge ordered by the time I had my progress hearing (whatever it was called). Judge realized he scared me straight, and dismissed charges at that hearing. No attorney or fines.

Frickers dumped all the garbage in North Monroe they could find on that road Sat night. My payback to them was I told this gigantor black male on my crew where they lived.

I didn't hire an attorney. Did Article 894 but I swear you had to be under .08 to get it.

One of my lawyer friends got popped in Montgomery long time ago (she refused to blow ) Judge told her in chambers that if it was up to him, he'd let her off with a lesser charge, but that MADD had already made it clear to him that if he downgraded any DUI charge, they'd make sure that his opponent in any upcoming election was funded to the hilt.
