Whats fricking ridiculous is the gun shop owners will prob have to settle due to how much it will cost in order to fight these baseless claims...

Won't the NRA or a firearms trade group step in with some legal defense? This should get thrown out, but we live in a crazy country these days.

Good luck with this! meant sarcastically. Can't see it working too much of a stretch. Would be great if it worked and put clamps on free trade of guns without proper registration. never happen though. NRA money flowing in will buy the day

The guy bought the guns LEGALLY and passed a background check... The gun shop can't control what he does after the purchase.

Please go educate yourself before making asinine remarks like the one above. The article states that even the lawsuit itself said the sales were completely legal; this is civil action sounding in negligence.

There is no such thing as "proper registration". Only 8 states require any form of firearms registration at all. LINK

Then the reverse would be discrimination. If the pawn shop did not sell the guns to, as the article says, "to a legally qualified person", because of "profiling" the buyer, then you would have a racial discrimination lawsuit on your hands....

Exactly. This is a damned if you do, damned if you don't.

I really wish there was a law that whichever lawyer loses the case, they would have to pay the others fees. Maybe it would stop all of the frivolous lawsuits.

Nice overreaction

you mean like what is the norm in canada, great britain and much of europe?

the intimation is that first-time gun buyers have hitherto been gunless simply because they haven't had the money. All the anti gun wackos are just poor.

By the way, this is not stupidity. This is litigious retribution and it's about to become the way of the world. The plaintiff is well funded and, while the lawsuit has no merit, the defendant is going to have to spend a LOT of money on a legal defense or a settlement. Now that the gun bill is dead, this will be the next wave of attacks. There is a lot of money behind this that will make it very hard for gun shops to deal with.

Given that it's in Mississippi, if it ever does go to to trial, any jury (or judge) verdict will be proceeded by at least 5 minutes of pure laughter.

12(b)(6)

I'd ask for Rule 11 sanctions also.

There's no doubt in my mind that "Ed" knew exactly what was going on when he sold the guns at a big markup. Whether the lawsuit succeeds is another story.

This is what makes me hope that the NRA, or some similar organization, comes to the aid of the shop owner.

This lawsuit will not survive summary judgment.

Pretty obvious all they wanted was a media story, likely to gin up additional support for the Brady Campaign and Bloomberg, they don't give one frick about the slain officer or his family. Just like the Newtown people, they are nothing but props to be used to advance a political agenda by any means possible.

You are of course assuming a judge rules on it who doesn't have a political agenda.

Which is a really stupid assumption on your part. The law is whatever a judge says it is, until a bigger judge overrules them.

Three guns for the sum of 1500. You might want to enlighten us on the big markup.

I doubt they're buying top of the line and they're probably not even buying new. The markup tends to be higher for these gray market guns.

So, based on this we need to hang a guy for making a lawful sale?
