Apple is facing a $5 million lawsuit claiming the tech giant’s iOS 9 crippled the 2011 iPhone 4S and made it unfit for daily use.

The new suit was filed in a New York district court on Tuesday, reported Apple Insider, suggesting the firm willingly advertised iOS 9 as being backwards compatible with the phone even though it knew about potential problems.

What’s more, the suit alleges that the new operating system made the iPhone 4S unusable. It says Apple schemed to force users into upgrading to new phones.

More than 100 people joined the class-action lawsuit that was filed on Dec. 29.

The suit also accused Apple of false advertising and deceptive trade practices.

“Plaintiff and other owners of the iPhone 4s were harmed when their devices’ software was updated to the newest version, iOS 9. The update significantly slowed down their iPhones and interfered with the normal usage of the device, leaving Plaintiff with a difficult choice: use a slow and buggy device that disrupts everyday life or spend hundreds of dollars to buy a new phone,” the lawsuit from plaintiff Chaim Lerman reads.

It also claims Apple uses security measures to block users from downgrading their devices to older operating systems.

Not sure how true, but my iPhone6+ and iPad have gone to crap since the update.

Technology becomes obsolete.

Cell phones become obsolete faster than almost any other tech.

Apple probably shouldn't have put the update out there for a phone that old.

They probably did do it on purpose, however you can't expect to buy a phone and have it get updates forever.

The problem is updates. If the hardware can't handle the software, don't push the software to the device. Pretty simple.

What's irritating is the fact that Apple has total control over whether or not you can roll back and how far, if at all. If making upgrades available on phones that probably shouldn't have it is just Apple extending a courtesy, they shouldn't actively block rolling back.

Everyone accuses them of this. I can imagine using a 4 year old cell phone. That alone makes it unusable.

Welcome to Apple. It's part of why I hate them.

Mine run smooth as silk.

And a 4S runs slow on the latest software? Who would a thought?

I had a 4s that suddenly wouldn't work after the update. I bought a new 6s.

Then the phone is vulnerable to security exploits, and apps that use new APIs won't work.

Either way someone will be complaining about Apple screwing them. Damned if you do, damned if you don't.

$5M is a rounding error and not newsworthy.

Because "older" software can't get security updates.... Oh wait.

When I had my 3g and they upgraded to the 3gs, my phone went to crap. It was noticeably slower, and almost unusable.

Like, suddenly and magically? Or did you install an update?

I had a 4S for a while and recall it working fine from iOS 5 all the way up to whatever iteration of 7 I was using before getting a Nexus.
