Only if the judges are politicians and don't care about law. That would be ....Legislating from the bench.....

Congress and trump, yes, very easy for them to draft those laws.

But SCOTUS essential to uphold Constitutionality of any laws passed by Congress - because you and I know the ACLU will be filing an immediate challenge to any such law.

SCOTUS job is to judge laws constitutional or not, correct. The ACLU and any other civil minded group should absolutely challenge anything this president or any other president signs in to law if they feel rights will be violated. Law is validated through challenges.

If he did, there is nothing we can do about it. Now if he sided with the constitution and you don't like it because you think he should have applied conservative party ideals then, you wanted legislating from the bench.
I am not making a judgment as I do not know enough about law and the case history. Just an outside perspective.
