true story: my mother threatened to sue the owner of the schnauzer that attacked her and got all of her medical bills paid for. but that was a fancy neighborhood.

You didn't kill the dog that attacked your Momma?

I've never heard of a Schnauzer that attacked a person before

Schnauzers are usually cool as hell. A little headstrong and cocky but pleasant enough in my experience.

For dogs in general it should be legal for you to kill them if they come on your property unrestrained....

Oh wait, it's already legal to do that in Louisiana. Never mind I'm good...

You have not met my ex's little shite Schnauzer. A kid in a bike it just and easy target for him. Told her she's going to get sued one day, or the dog will get shot.

If you want to own an aggressive breed (Pit, Rottweiler, Doberman, etc.) you should have to carry a stand-alone liability policy specific to the animal.

So how do you enforce this?

a new enforcement unit? Take police off other things to police this?

Also, what is the punishment?

Who gets to decide what type of a dog is it? Cause its pretty easy to missclassify breeds?

All good questions, which is why someone should possibly face criminal charges.

Basically, we don't care what kind of dog you own or what you do with it, but if it hurts someone, you face criminal liability.

Now that criminal liability could also be in the form of court-ordered fines, which could benefit the victims.

You should also be required to be free of government financial assistance.

So you should be able to demonstrate the ability to care for yourself without government assistance before you are allowed to care for another living creature, whether it be a dog or a baby?

I like it.

Do circumstances matter?

I mean, if your kid climbs my fence while my dog is in the yard, why the frick should I be liable?

On the other hand, if I'm out with my dog off leash and it takes off and attacks your 5 year old......yeah

If my dog attacks someone whether it's a kid that climbed my fence or on a walk, I'm a complete failure as a dog owner and my dog sucks. I have a Aussie Shepard and border collie mix and she wouldn't harm a fly regardless of what was going on. I have a 9 mm for intruders. She's a certified therapy dog.

Can we just start with enforcing pet owners to pick up their shite?

I work for an agency that writes for about 15-16 homeowner companies in LA.

NONE of the companies I write for cover liability for pit bulls. Some will write the homeowner policy with an exclusion in the policy for certain breeds, others won't even write the homeowners policy at all if they have a dog on that company's banned breed list

Well, my Aussie and Goldie would attack them and they'd be stricken with massive saliva damage. LOL.

But, that's not my point.

If you enter my space without permission, you bear some of the responsibility for that choice.

I shouldn't have to build a fortress to keep you out to keep YOU safe.

Do circumstances matter in other crimes?

Of course they matter. That's why we have judges, DAs, etc.

(I'm not saying I'm for all this, just interested in the discussion. I'm against more laws and government oversight, but I'm for personal responsibility.)

GFY

You can google "black lab mauls" and find out for yourself that these are all animals that are capable of killing.

You could put down millions of dogs in the breeds you listed and people would still be attacked.

Please do google what I asked. Can't wait to see how you spin it when you realize even "family friendly" dogs can attack

I agree with your statement, but certain breeds can do tremendous damage when they "snap" while others don't.

Any dog can get aggressive and snap or bite someone. It's the rare dog that has the desire and power to maul someone.

I would never disagree that some breeds inflict far more damage than others.

pit bulls

Today, this breed is the equivalent to the German Shepherd, Rottweiler and Doberman Pinscher of the 70s, 80s and 90s.

Many times, the result of an attack can be traced back to its owner, how the dog was raised, disciplined, rewarded and whether or not the dog received enough daily exercise.

How did I know this thread was going to be full of so-called "small government" conservatives foaming at the mouth to intervene in what private citizens can own and do with their property?
