What should be the liability for dog owners?

There are always threads on here and OT about pit bulls, etc.

I don't care what kind of dog you own, but you should be responsible keeping it under control and not injuring anyone.

What should be the legal level of liability for dog owners? Should it be strictly civil? Or should some potential criminal liability be applicable?

In the case of Pit Bills, you should be required to have liability insurance.

You should also be required to be free of government financial assistance.

It's covered by your homeowner's insurance. If your poodle actually kills your neighbor you're gonna have other issues.

usually, depending on the breed, you get "one free bite"

now, some breeds are "dangerous breeds" and them causing problems is basically instant trouble

Homeowner's insurance is not required by law. I doubt most owners of Pit Bulls have insurance.

Exactly...why would you have homeowner's insurance when you live in a duplex rented under your girlfriend's name?

So what do you do?

Most pet owners are not going to have insurance (let alone pit bull owners) for their animals. And they probably don't have shite in terms of assets, since most americans don't have shite.

true story: my mother threatened to sue the owner of the schnauzer that attacked her and got all of her medical bills paid for. but that was a fancy neighborhood.

your only hope is that the folks have homeowners....

options are:

(1) their insurance would pay damages
(2) your insurance would pay damages, then go after them
(3) they dont have insurance and you are stuck with either #2 or going after their personal assets

If you want to own an aggressive breed (Pit, Rottweiler, Doberman, etc.) you should have to carry a stand-alone liability policy specific to the animal.

Why make someone have liability insurance that's like making someone have health insurance. If they want it then get it and if not don't get it. Can't afford it then don't get it.

For the very same reason drivers have to have liability on their vehicle.

If a person can't afford the $100/yr insurance policy, he doesn't need to be exposing other peoples' physical/financial well-being to his lack of recourse should the dog cause damage.

This is not comparable to health insurance.

I'm not saying I am for forced insurance, but comparing it to health insurance is incorrect.
