The girlfriend of former USC kicker Matt Boermeester said Sunday that the Title IX investigation that led to his removal from the school’s football team was “horrible and unjust” to her and Boermeester.

Zoe Katz, 22, a senior, said in a two-page statement her attorney emailed to The Times that Boermeester “has been falsely accused of conduct involving me.” Katz confirmed that the statement was hers. Her attorney, Kerry L. Steigerwalt, said that USC alleged that Boermeester shoved Katz outside her home.

Mark Schamel, an attorney representing Boermeester, said Boermeester was not permitted to return to USC following the school’s investigation, in which USC alleged that Boermeester assaulted Katz. Katz has denied this, as did Boermeester, through his attorney.

quote:

In the statement, Katz said she and Boermeester have dated for more than a year. The Title IX investigation began, Steigerwalt said, after a neighbor witnessed Boermeester and Katz roughhousing. The neighbor told his roommate, who told a coach in USC’s athletic department that Boermeester was abusing Katz. The coach then reported the incident to the Title IX office.

Katz said she was summoned to a mandatory meeting with Title IX officials, where she told investigators that the two were playing around. Katz was subsequently told that she “must be afraid of Matt,” she said. She told officials she was not. Boermeester has not been arrested or charged with a crime.

“When I told the truth about Matt, in repeated interrogations, I was stereotyped and was told I must be a ‘battered’ woman, and that made me feel demeaned and absurdly profiled,” Katz said. “I understand that domestic violence is a terrible problem, but in no way does that apply to Matt and me.”

Katz said that she has “never been abused, assaulted or otherwise mistreated by Matt.”

Boermeester, who kicked the game-winning field goal for USC in the Rose Bowl, was suspended from USC, then barred from campus and from meeting with USC’s athletic trainers or members of the football team. The school also barred Boermeester from contacting Katz, she said.

Opponents of Stalin got a fairer trial than this young man. It is high time Congress stepped in and required accredited universities to provide students accused of misconduct with the protections afforded them in the Bill of Rights.

Who wears a shirt that's wrinkled as frick to a photo session? fricking millennials.

As for the article, can someone tell me what title 9 relates to this? I thought that was only concerning making sure things like scholarships and other opportunities at a college were the same for men and women.

Title IX is so fricking scary.

If Trump got rid of it, I'd be first in line to jerk him off.

I'd argue its closer to an inquisition trial where youre guilty no matter what, its just easier to confess and ask for mercy than fight it.

How these are constitutional are beyond me.

To sum it up, campus entities are using Title IX for enforcement actions on campuses that involve no due process.

You would think with these kinds of consequences that Title IX investigations would be fair and impartial. But you’d be wrong. All too often they are kangaroo courts lacking procedural safeguards, protections for both accused and accuser, and lacking in all elements of fairness.

the ENTIRE reason the Obama admin shifted the burden to colleges was to make "prosecutions" easier

and that's not some kooky conspiracy theory. it's oft-repeated

Why do schools handle sexual violence reports?

quote:

For many survivors, campus reporting is their only option. Many victims of sexual violence don’t want to turn to the criminal justice system: they may fear skepticism and abuse from police, prosecutors, or juries; they may not want to go through the ordeal of a long trial; they may fear retaliation from their assailant, who will most likely not end up prosecuted, let alone convicted; and they may be hesitant to send their assailants to prison. But even survivors who do report to the police are often abandoned by the system. Only a quarter of all reported rapes lead to an arrest, only a fifth lead to prosecution, and only half of those prosecutions result in felony convictions. Additionally, not all state laws cover sexual violence perpetrated by women or a person the same sex as the victim; some don’t recognize men as victims at all. Schools, unlike the state, must take up every report for adjudication and response according to the victim’s wishes. For most campus survivors, then, their school may be their only resource for justice and safety.

quote:

Colleges and universities can act quickly to protect students. Schools, unlike the criminal justice system, are in the position to take action quickly to ensure a safe campus; if they had to rely on the criminal justice system to try the case, the college would have to wait years for the assailant to be taken to prison (which only happens in three in 100 rapes). As the school waited for the trial to conclude, the victim would be left on campus with their perpetrator – or perhaps forced out of school for their safety – and other students would be vulnerable to repeat violence by the assailant. If you don’t want rapists on campus, we need schools to be able to figure out if violence occurred and take action.
