You know what is one of the stupidest things in America? A lawsuit to enforce a non-compete. In my experience, it's always a bunch of bumsquirt.

You probably thought that "right-to-work" legislation actually protected your "right-to-work", didn't you?

non-competes are very difficult to enforce, BTW. If you have to violate one to get by - frick em, let them try and force it.

The problem is that a lot of companies spring this crap on employees after they begin working there, not at the time of hire. I would be behind a law that would require an employer to ask you to sign one at the time of hire or it can't be made a condition of employment.

They could ask you to sign one later, but that could be negotiated and failure to sign could not be used to fire you.

20 years in college ago I took a job at Dominos and they actually wanted me to sign something that said if I quit, all of my unpaid hours that I had already worked would have the wage changed from 5.15 an hour to 2.75 an hour. You think that was enforcible? I never signed it anyway, morons just hand you a bunch of paperwork to sign and never look at it!

So ... is Jimmy John's gonna track Jerome the Sammich Maker when he stops showing up for work... and then later on gets another job at a Subway in a truck stop ?

Probably not. It would cost more to enforce than it's worth. And any customer can figure out how to make their sandwiches.

They'd go after someone in management--that person would know some of the inside secrets and would have existing relationships with vendors, so they could do a little more damage to the company by working for or starting up a competitor.

I consider that stupid as well, despite it having nothing to do with my other comment.

Anyone should be able to join a union. No one should be forced to pay into a union or join a union.

Non-compete's are just stupid. I have been asked to sign a non-compete 2 different times in my career. I refused both times and still got the job.
