Partially. It stands alone as a political / common sense point.

It also undermines the basis for Trump's executive order. He is using an immediate threat as the basis for the EO and to fight any injunction, while not being able to articulate any immediate threat that his EO would address.

But that is only part of the legal argument against the EO.

oh i agree. but that argument is a terrible one

that is literally having the judiciary review the justifications for executive actions. that's a clear violation of SOP

now the EO violating constitutional or statutory limits could be valid and are legit legal arguments

How does his EO miss the target completely? What in the fck is wrong with a temporary ban in order to sort the immigration process out and make it as secure as possible? There is nothing wrong with it, the only reason the hysterical left is freaking out about is because Donald Trump imposed the order.
