No public defender = plead guilty, save money.

Louisiana Can’t Afford to Pay for Public Defenders, So Inmates Are Pleading Guilty

Everyone should have the right to counsel

The sheriffs and DA lobbies here are very powerful. DAs want higher conviction rates and people in their PTD & probation systems for money and sheriffs want bodies in the jails for extra funding. Criminal justice reform here is hard because the average voter is a retard who doesn't understand that this kind of system costs us more money in the long run.

Jesus, I don't know if a $200 lawyer is any better than defending yourself.

Can the Louisiana bar step in and encourage more pro bono to stave off the collapse?

This isn't a new problem. Having a Louisiana public pretender isn't a big step up from having no lawyer at all. Its been that way all my life.

The governor should walk around everywhere in a military uniform festooned with medals and ribbons so Louisiana can truly embrace its banana republic identity.

Good. I just hope they aren't giving the criminals reduced sentences if they plead guilty

State District Judges don't have the balls to draft lawyers into service to cover the gaps - just IMHO.

You would want a tax lawyer or probate lawyer who hasn't looked at the criminal code in decades defending life felonies? Lol at this board

If they put forth an effort on behalf of the accused it would be a great improvement. The vultures who make a living off those indigent cases do nothing on their behalf.

Can the bar not encourage criminal defense attorneys to perform more pro bono?

In small government, the DA and the public defender are funded from the same pool of money. They are given equal, dedicated resources.

DA's nor police should receive any revenue from tickets or asset forfeiture.

Workers at crime labs who purposefully yield fraudulent results should suffer the same sentence that was imposed on anyone wrongfully incarcerated due to those fraudulent results.

Assets can only seized with a formal criminal charge, they must be connected to that charge, and in the event charges are dropped or a not-guilty verdict is reached, they must be returned to the person, or persons, from which they were seized immediately and without any further proceedings. People who had their assets seized should not have to then sue to get their stuff back after already having to fight to be exonerated.

If we still have to ticket and have asset forfeiture at all, that money should go into funding roads and only roads.

They already have a set number of hours that every attorney has to perform pro bono.

The bar can encourage whatever they want. Do you think defending a case is just showing up for trial? You need to spend money on investigators, sometimes expert witnesses, etc. Not to mention criminal defendants are notorious for filing bar complaints. So essentially ask them to lose money because the state of Louisiana will not comply with the Constitution??
