Without a confession, or other overt acts indicating intent to remain away permanently, like burning his uniform, there is no evidence of desertion.
Should he be charged with desertion the burden of proof is on Bergdahl to prove he intended to return.

Someone should tell those guys over there to stop shooting at our soldiers then

You don't know what the frick your talking about. If he is charged with desertion the burden of proof is on the pussy to prove he is innocent not the military to prove his guilt. In a military court you are guilty until proven innocent.

That is correct as I read Article 85.

Is this for real? On the one hand we have the Democrat shills saying he's a prisoner of war, then one come back and says he doesn't fit the definition for desertion execution because... get this... We're not at war.
These Democrat talking points are serious insults to anyone with an inkling of intelligence. But hey, the liberals drove education in the shitter for this very reason, to dupe the masses. It's a-workin', too.

In his 5 years, he has never been classified as this, except by a few idiots in the White House. Defense dept doesn't recognize him as such, and that's who counts. It would be a new designation if it happens....

And Korea was a 'Police Action".

Even if he declared himself a mujahid? That's actually treasonous, I'd assume.

No one has been executed for desertion since WWII. And from what I've read it was extremely rare even then. Bergdahl will not be executed. I wish he were, but it's not going to happen. At best he'll be court martialed, receive a dishonorable discharge, and forfeiture of all pay and benefits he may have received or is due to receive.
That's if the administration allows the DOD to charge him. Likely what will happen is that Bergdahl will receive his back pay and be told to move along with his life quietly so this story will just go away or he will have to face charges.

Can the families that lost loved ones looking for Bergdahl...sue for negligent death? I hope every body that can, does everything they can to make this guy and his family pay dearly for their disservice the them that lay their lives on the line.
Obama sucks. Period. I'm done.
Go Rajun Cajuns!

No. That's a terrible idea and would set the worst precedent imaginable for our military.

Well, yeah, thats what I'm trying to confer to ole spidey, who thinks he's a POW...

GT23, my point was that technically, Korea wasn't a declared 'war', either. We may not have declared war, but our guys are sure as hell in combat.
Posted on 6/8/14 at 7:29 pm to FightinTigersDammit
I understand your point and I agree with you. I was just replying to the last post because I'm lazy. "Declared War" has absolutely zero to do with his status as a deserter.

Listen to the keyboard warrior give advice about the military. GTFO troll.

He did. He's been destroyed on this exact subject twice in one afternoon. He probably went back to his leftist websites to let them know that their talking points are complete horseshite and that he needs new material before he shows his face again.

nah, he honestly believes he's right, even though he's been proven wrong many times.
once again, liberals are shown to be complete morons when it comes to anything military related.

According to the Universal Code of Military Justice, desertion during a time of war is punishable by death.
