He might be eligible for POW status and the benefits that accompany it.

In his 5 years, he has never been classified as this, except by a few idiots in the White House. Defense dept doesn't recognize him as such, and that's who counts. It would be a new designation if it happens....

...a department that exists within the Executive Branch of the government... which is run by the President.

If the President wants him to get POW status then the dude will get it.

Desertion requires proof of intent to remain away permanently. And even if that is proven, no. He's not going to be executed just because Obama got him back and you really hate Obama. Sorry. We haven't executed a soldier for desertion since WW II and we aren't going to start just to make FOX News viewers happy.

I hate traitors much much more than I hate Obama. You don't seem to have an issue with them though.

I realize this is the talking point you've been told to spread around, but it's completely false.

Bergdhal was captured within 24 hours of leaving base. He was never wilfully off base for more than 30 days, and thus was never classified as a deserter. Without a confession, or other overt acts indicating intent to remain away permanently, like burning his uniform, there is no evidence of desertion.

I'm very sorry that your deep hatred for our country has blinded you to basic factual reality.

I pulled this so called "talking point" directly from the UCMJ. Would you like to read it or do facts scare you?

Death because of desertion is only during a time of war. America is not at war.

You like to harp on this 30 day thing like it's some catch-all for your argument but you have no idea what you're talking about.

If you lay down your weapon, abandon your post, actively seek out the enemy...you are not just a deserter, you are a traitor.

This is not a partisan issue...although I know exactly why all the liberals are making it into one.
