The lawyer arguing in favor of the US government is incompetent

My goodness, he is getting destroyed, and I don't know shite about law.

The judge question "do you have any evidence implicating these countries in terrorism?" he started blabbering about nothing

His answer should have been

"Yes your Honor, ISIS is thriving in these countries, and occupy lot of land, about 20 % of the population are ISIS fighters, You do the math"


He will lose bigly, not sure if he can win even in front of a conservative supreme court.

This isn't a debate about evidence.

It's a debate about the ability of the Judicial branch to override the explicit authority of the executive branch spelled out in the US Constitution.

The rest is just grandstanding by the 9th circuit.

You do realize judges make decisions based on their own interpretations of the law and not what each side argues, correct?

They can't raise arguments here they didn't raise in WA either

This is just on the stay, though, they'll be able to raise all kinds of arguments on the merits

But whoever was running the show in W.D.Wa really got lazy

You could have the best conservative legal scholar in the world on your side and those hacks on the 9th would still rule against you.

SCOTUS is where its at and why we need to get Gorsuch confirmed.

Oral arguments aren't that important, so I've heard. I guess if someone was really unprepared or had absolutely nothing coherent to say, it might lose the case for them.

I love how judges on the FEDERAL CIRCUIT COURT are literally aggressively cross examining the US DOJ over useless facts, when the real question that they explicitly know is about separation of powers.

It's actually scary to listen to.
