Especially because you then have to count on either getting Gorsuch on or flipping one of the liberals. A tie doesn't help Trump.

Dershowitz mentioned last week that Trump should have let the AG ride it out and hired external counsel to defend the EO. Probably would have worked out better for him.

Problem is that the lawyers on the case originally worked for Jones Day (largest law firm in the US, print their own money) at the last minute made them pull out. Filed an amicus brief against the ban. Make of that what you will.

if it was a debate about evidence then saudi arabia would be on the list, among others.
face it, trump f'ed up this EO. doesnt mean his idea doesnt have merit but the lack of due diligence and developing this is somewhat embarrassing and was a clusterf

The EO isn't solely based on countries that produce terrorism. It's also based on countries which are unable to participate in the vetting.
