2) Which interpretation? There is at least one in which "kill" is said to really be more akin to "murder" (as in wrongful taking of life). I assume that you are not such a pacifist that you believe Gawd meant that you are not allowed to defend yourself or your family? I assume you do not think that you have "sinned" if you accidentally kill, etc.
I have no knowledge of the facts of this case. But, IF the dead guy was truly molesting the child, I can certainly understand beating him up. And, i further presume that the man was angry and just beat him and the guy died. I doubt that the cool collected thought was "I shall continue to beat on him until he is dead". People have died in boxing matches. It is not a stretch to think the father beat the guy and the guy happened to die.
