So a US border patrol agent blows a Mexican kid away on Mexican soil in 2010

The kid was 15 years old and involved in smuggling so he was a worthless sack but his family has brought his case before the Supreme Court saying his Constitutional rights were violated.
The kid was a Mexican citizen and not even an illegal immigrant in the US. He lived in Mexico.
Sorry but your dead kid doesn't have US Constitutional rights.

The boy was shot by an American and somehow we are suppose to be responsible for the kids life. No, this was the US Border Agent fricking up. Even if shot on this side no way is the kid receiving Constitutional Rights.

The fact that this case made it to the supreme Court is indicative of how messed up our district and appellate courts are.

Relevant facts.
They were both on the banks of a river (Rio Grande I believe) under a bridge right at the border. I have been down there and you never really know if you are standing in the US or Mexico at any given moment. It's not like this occurred in Mexico City. The kid was hurling softball size rocks at the BP Agent's head and at a group of illegals he was detaining. Agent issued warnings and then fired when the "kid"* picked up another rock and rared back to throw it. The shooting was deemed a legal use of force by investigating authorities.
The issued of shooting rock throwers is a constant point of contention on the border. Certain segments of the population feel that defending yourself against someone throwing baseball sized rocks at you is unreasonable. Having been there and seen the stones being thrown, I disagree strongly and would challenge anyone who feels differently to stand still while I chunk rocks at them.

It is a joke really. They know how weak our judicial system is and that there's a chance to get some free money here. You think they'd try this with Russia? Hell no! They would be scared shitless to try this with Putin...he'd laugh and then order them "missing". All the world knows that our courts are a push over, so they take their shots. It needs to change. No foreigner should have any rights what so ever in this country.

Do you have a source to back up the smuggling allegation?

I was hoping most could read between the lines, but i guess you can't. You sound like Crap News Network putting words into someone's mouth.

I heard this story this morning. It seems the kids were playing a game where they would run across the border, touch the US fence and run back. The agent gets there and the kids run away. I think he grabbed one of them. The kid that was shot was hiding behind a bridge pillar and the guy took aim and shot him in the head when he peeked around it.
There is a video of what happened. I think an alledged witness, a woman, said the boys were throwing rocks.
At least in this report, it was not stated that these kids were doing anything but playing a game. This kid posed no threat at all to the agent when he was shot.
As to his 'Constitutional Rights", I defer to the courts.
But what I heard this morning, with someone narrating what was going on in the video and hearing the shot, this was a pretty sorry shooting.
I wonder what would happen if a gang of kids were doing the same thing and a Mexican border agent shot one of them. Y'all would be wanting to go to war!
