Unless that pursuit of happiness involves smuggling drugs across the US border, and assaulting US boarder patrol agents (throw rocks at someone and see if you get charged with assault) from a perceived safe space. If the potential assault endangers the officer I don't care where your feet are planted.
If the kid was out of throwing range and the rocks had no chance to affect the officers safety/ability to operate on US soil then I have an issue with deadly force
I can think of a way to test the Mexican stance on this situation though. Go stand on the American side of the border humming baseball sizes rocks at armed Mexican personnel on their side and see what their protocol is.

No kidding. Reading some of these posts makes me just sad for humanity. I figure it's just internet toughies though cause if your legitimately happy a kid is dead, something is broken inside of you.
There's a lot of story to this that none of us know yet. There's cell phone video of the border patrol agent firing 3 times and the 3rd shot killing the kid. The person recording did go on to say that a group of kids were throwing rocks at the agent but had stopped.
Supposedly the defense team for the border patrol agent has stated there's video of the kids throwing rocks even during the shooting but they won't release that.
Pretty sure the border patrol agent just fricked up massively at this point. If not, then our border patrol can just sit at the border and shoot kids in mexico for target practice.

Well said. It is truly a shame. A child is dead over something so insignificant.

The kid and his family does not have the rights of a US citizen.
I don't know anything about the law when it comes to international incidents.
My question is was the border patrol agent in the US or Mexico? The kid was in Mexico and if the bullet came from the U.S. it seems like it would be in the US court system. If the agent was in Mexico it would be in their court system.

In Verdugo-Urquidez SCOTUS held that the 4th Amendment didn't apply to Mexican citizens who hadn't ever been to the US. If the kid was still in Mexico, I don't see how why he would get 5th Amendment protections. And if CBP ruled this a justified use of force, wouldn't this be a simple justification to a wrongful death suit?
That said, it scares me that some of y'all think it should be open season on people crossing the border illegally.
