If someone was spying on flynn then that is a problem in and of itself. He was a civilian at that point.

The Doj has been investigating the Trump team since July this past summer when internals revealed Russian activity into the election.

The NSA monitors all foreign phone calls no matter who you are. They obviously turned over transcripts of intercepts to the Fbi.

So if the discussion was leaked to to the media, what was it about?
I can't imagine incriminating information would be withheld given what the dems and media were put through during the campaign, taking the giant leap that OP is even close to true.

Is there more than one participant in a typical telephone conversation...hmmm? Would there be fewer legal hurtles to collecting on one side in this case than the other, while having the same effect?
