quote:

In Lafourche Parish, plaintiff Keith Arcement has been jailed since August on drug, gun and battery charges, seeing a revolving door of public defenders, none of whom has investigated or filed any motions in his case, according to the lawsuit.

In Winn Parish, plaintiff Rory Gates has remained jailed since July on drug distribution, firearms and possession of stolen property counts. His attorney, who serves as a prosecutor in a different court, "has spoken with Mr. Gates only once and then for five minutes," the lawsuit states.

"Our nation continues to wrestle with the crisis of mass incarceration. However, nowhere is this crisis more stark than in Louisiana," Clarke said. "Despite this, Louisiana fails to live up to its constitutional obligations to provide counsel to the poor, leaving many defendants literally defenseless."

Yea. Have you heard rumblings that they may start appointing private attorneys en masse? Didn't know if that was a rumor or had a ring of truth to it.

that is not a solution

Maybe his previous IDB lawyers are trying to be like a former one in St. Martin parish and become the warden in the jail

the way this state runs the PDO system is fricking criminal

The DA's offices in my neck of the woods use the PDO as a farm league to hire the good attorneys as the difference in pay is huge.

ok tradeoff question for evangelical-authoritarians and LEO:

legalize and tax weed to pay for the PDO so your taxes aren't dramatically raised

deal or no deal?

Ah. It hasn't happened in my area too much that I know of. I have no clue what I'd do if it happened to me. I know jack shite about criminal law.

I have no problem with legalizing and taxing weed. If you think that money would go to lawyer fees tho....

at our professionalism thing last semester we had a 60 year old attorney who talked about her experience being thrust from insurance defense to having to defend some guy on attempted murder in NOLA. couldn't imagine having to do that at that age.

The DA's are using pre trail intervention exclusively on most first offense crimes against property and society. This is diverting funds (court fines and costs) into their coffers. Part of the fines and costs go to the IDB. Its not all of the problem but a big part.

oh i know

PTD is a huge money-making scheme for the DA and kills the PDO. win/win

apparently some judge in NOLA mandated that. if it wasn't attempted murder it was definitely felony gun possession or something. i remember thinking "the frick" at the time.

No doubt, my cousin Connie never touched the wacky weed and he got locked up for 5-10.

Oh wait, no he didn't, because it's pretty easy to not do illegal shite
