Well they might have just prevented someone who shouldn't have a gun from having a gun. If she can't do 5 minutes of research as to where she can and cannot have a gun or certain ammo, I don't trust her judgment with the gun in the first place.

This is a good point and an excellent example of where jury nullification should happen. It's ashamed that the legal system suppresses education on jury nullification.

I hate this for the lady. Its unfortunate. But ignorance of the law is not nor should it be a defense. 3 years is ridiculous and exposes NJ for being over empatic when it comes to sentencing for simple possession of a gun.

There are ways to transport a gun through New Jersey. This wasn't the case with her. She was bringing her gun for a night of partying in Atlantic City... at best.

I would criticize the Pennsylvania concealed weapon authorities for not making sure that anyone who receives a license knows fully that their license doesn't apply in neighboring states. I would if I had reason to believe they didn't do that with her.

What a mess. Hate to sound judgmental or anti-gun (I own some myself), but it does sound pretty sketchy. This "birthday party" sounds like a major event, not very spontaneous (leaving the state et al), and so you figure she already was making these plans when she bought the gun... wouldn't you have asked about interstate traffic?

From what I've read, you have to involve an FFL to get a handgun in Pennsylvania, even if from another person (not a store)- to do the exchange.
I read that online, in a forum asking about best places to buy and exchange a handgun- a Penn poster commented that was the law for pistols there, no meeting in a public parking lot etc (unless for long guns only).

In a slightly related aside, hollowpoints in a .380; a lot of people say they aren't very effective anyway. Serious risk of underpenetration and/or lack of expansion. A bunch of ballistic data backs this up (google for stuff on 9 makarov, a similar but slightly hotter round). It would suck to face extra charges, simply because you fell prey to marketing and bought more expensive ammo.

Couple of questions.....routine traffic stop, did the cop search her vehicle or did she volunteer the fact she had a firearm in the car?

Secondly, the government has purchased millions of rounds of hollow point bullets....are they allowed to carry them in New Jersey?

This administration is currently picking and choosing what laws to enforce....pot is legal in several states but remains a federal crime. Border enforcement. Refusing to investigate/prosecute the IRS employees for releasing protected documents...the list goes on and on.

Especially when you are driving directly to the Southeast corner of the state which shares no border with another state. Technically you could take the ferry from Cape May.

I do believe the rules are for you to carry the gun unloaded in a locked container, but I could be wrong.
